  • car beyond repair yet still have 4k left to pay!

We bought an 2006 ford c max car on finance last April, car was 4k to buy but with finance it was £5700. Within the first 6 months the alternator went and the turbo - this was under warranty and we had 5 month of a good run, recently we have had a transmission malfunction come up on the bash board and after taking this to various garages it turns out that the gearbox could only be fixed by ford. The car went in last week and needed 3 different parts amounting to £1600,we agreed to the work being carried out and once they were fitted and test drove ford rang us to inform us that the car still had issues and now needed a new gearbox amounting to £2900 on top of the £1600 and that if we were to go ahead they couldn't tell us when the part would be coming in as basically they aren't produced anymore! We are now without a car had to hire one and will need to buy another car! We are also left with 4k on the car for the next 3 years and can't hand the car back under the early termination as it doesn't meet the requirements gearbox wise! Please if anyone can help or inform us to how we can possibly get out of the rest of the finance I would greatly appreciate any advice!

    Hi and welcome.

Being a ten year old car is going to make it difficult to claim against the original seller, unless you can show the fault was already present when you purchased the vehicle, or that this sort of fault's not expected in a 10 year old car.

I would however be asking more questions of the Ford garage:
What were the parts that cost £1600?
    Were they gearbox parts?

How can a NEW gearbox cost £2900, when they are no longer in production? Or is this a secondhand replacement?
If so where would they be sourcing it? Would they overhaul it

If the agreement was to fix the gear box for £1600 you may have protection under Sections 50, 51 & 52 of the Consumer Protection Act 2015
