    Hi,
    Need some help last Saturday I received a letter from B W Legal their client is Lowell Portfolio original creditor was Shop Direct Finance, about a £4,393.91 Judgment arrears and if i didnt contact them by the 15th they would issue a warrant of control, so i wrote them a letter telling them that this is the first I have heard of any of this and I had no knowledge of this so please could they tell me how this all come about.
    And its true i have know idea where this as come from, now today Saturday the 18th I receive a warrant of control from my local county court telling me to pay £172.25 for something I don't owe now I am going to apply to set aside and apply to suspend the warrant, can someone help me with the defence to set aside also where do i send the application.

    Did you have a Shop Direct account & if so did you owe them any money? If you did how long ago was this?

      Hi I had a Littlewoods catalogue 12 years ago i left that address 2005 but im sure never left owing money

        You need to find out more about this and a good start is by finding out about the CCJ and the address it was issued to. There could this has been done sneakily by using an old address for a Statute Barred debt to get a Default Judgment.

            You could check your credit report (Noddle is free) ... any ccj's/defaults would show up on there
            Debt is like any other trap, easy enough to get into, but hard enough to get out of.

              Check with Littlewoods, they may be able to tell you what if any the outstanding existed.

              Lowell: Write to their COO Andrew Bartle, requesting all information they have on the alleged debt, and to what address the claim was issued.

                  Hi, just received some info from bw legal. They say I entered into an agreement in March 2008 and last payment was April 2012. now I know this is Not me help what do I do now.

                          It was for £53.94. I have emailed bw legal to found out all details on how it was paid

                            Ok,
                            You will need to collate every bit of evidence you can put your hands to show this is ID theft.

                            Put BW Legal on notice that you believe that the account was opened fraudulently and that you do not acknowledge any liability for the alleged debt.

                            If you are convinced that the account is fraudulent it should be reported to police and Action Fraud.

                              I'm just thinking out loud here. I wonder if you moved in 2005 that the new resident carried on using the account as they kept writing to that address. You may have to be able to prove where you lived 2005 onwards.
