    If you are an officer of the company you can defend otherwise you'd probably need a solicitor which would cost more than the ticket, so worthless. As an individual you'd be able to defend yourself but with companies only officers of the company have a right of audience.

      hello M1 , as i stated in last post i received a letter from Vanquish asking me to pay £160 ON OR BEFORE THE 17/7/16 OR ELSE ? , WELL TODAY I HAVE RECEIVED 2 MORE LETTERS , one from Parking Awareness company informing me that they have sold the debt to MIL Collections LTD TRURO , the other is from MIL stating that they have purchased the debt on want £100 to settle , and in the letter it has LETTER BEFORE ACTION and are giving me notice that they are preparing to recover via small claims curtained do not underestimate the seriousness of this letter , what should i do (next step ) thanks

            hello kati , just a note to my last reply , it was 2 separate letters arriving at the same time , i was given till the 17th from Vanquish ,now , these letters dated 8th and 9th giving me 14 days ,don't these firms give you what it states in corresponence , and the envelopes both from Truro but PAS blackpool details on one and MIL on the other

                hello M1 thanks for your reply , i have been doing a bit of research regarding MIL,and it seems that they are a similar outfit to most of the company that call themselves respectable , the letter they sent me is a template letter with my details put in , i await your advice of my next move if any , as i have said before i am prepared to go to court ,but you are more knowledgeable on the right root than me ,its about time the government of this country closed cowboys like this down ,they are scammers and con men and want putting down Thanks for any advice you can give

                  I write in response to your letter before action dated 9th July 2016, the contents of which are noted.








                  As the pre action protocols expect us to exchange sufficient information to understand each others position please forward to myself the original parking charge notice and a picture of the signs at the location as well as the operators contract which allows them to operate at the site (or indeed confirmation they own the land in question).








                  As well as the information already requested please answer the following questions :-








                  What type of car park is it ?








                  What contravention gives a cause of action ?








                  Who contravened your rules ?








                  Who you are pursuing ?








                  Have you followed the rules laid down in the Protection of freedoms act 2012 schedule 4 ?








                  How is the £100 made up ?








                  Not only will this information help comply with the pre action protocols it will also help achieve the over riding objective.








                  Having done some research on your claims i request that if you ignore my requests for information that your claim complies with








                  CPR 16








                  Contents of the claim form
                  16.2
                  (1) The claim form must –
                  (a) contain a concise statement of the nature of the claim








                  Contents of the particulars of claim
                  16.4
                  (1) Particulars of claim must include –
                  (a) a concise statement of the facts on which the claimant relies;

                  Other matters to be included in particulars of claim






                  7.5 Where a claim is based upon an agreement by conduct, the particulars of claim must specify the conduct relied on and state by whom, when and where the acts constituting the conduct were done.

                  Who may sign the statement of truth
                  3.1 In a statement of case, a response or an application notice, the statement of truth must be signed by








                  (2) the legal representative of the party or litigation friend.








                  3.7 Where a party is legally represented, the legal representative may sign the statement of truth on his behalf. The statement signed by the legal representative will refer to the client’s belief, not his own. In signing he must state the capacity in which he signs and the name of his firm where appropriate.








                  3.9 The individual who signs a statement of truth must print his full name clearly beneath his signature.








                  3.10 A legal representative who signs a statement of truth must sign in his own name and not that of his firm or employer.

                  10 Any provision of the CPR which requires a document to be signed by any person is satisfied by that person entering their name on an online form.





                  Further, i believe your claim claim smacks of champerty and maintenance and that your deed of assignment is not valid as it does not contain any reference to specific parking charges.

                    hello M1 ,thank you for all your effort , i will get my daughter to type it up , just a few questions , are we asking for photo evidence they have , they will struggle with that , the have my address but don't no who the driver was , so do i sign the letter with my name or put a squiggle , and finally send by email , first class ordinary post or registered , as i seems the letters to these cowboys to to go missing quite often , thanks again

                      They may not have photo evidence but the PCN, if sent to you which i think it was, usually has them and we have asked for a copy.

                      The registered keeper can put their name as they have that and it will be the registered keeper who is being chased at present is it not ?

                      Email for me. Cheaper and more reliable.

                          good morning M1, believe or not there is no email address for MIL on their letter and i looked up address on the site and the only address it comes up with (page) is a small writing space for answers , with no email address ,how will i proceed THANKS

                            Phone them up and ask for an email address. If they won't give you one then post will do, with a proof of posting or via recorded delivery.

                                hello M1 , just to keep you informed , contact acted MIL and asked for email address , off hand with the reply , we don't give emails to anyone , what do you want it for , case number , post code , so hung up and they ring me back , different attitude this time , do you want to pay , NO , is the a dispute or are you disputing it , YES ok here is the address , nothing like MIL so thought best option was to get the letter sent by recorded 1st class , cost a bit more , but they will have it by 1pm tomorrow , so i will keep you informed of any communications , but if they try ringing me i will not be answering , the only way is to post to me as they don't have my email THANKS keep up the good work ,these cowboys want shutting down
