I am unemployed but work part time - one day a week which has been declared; but my benefit has been stopped as they think I can live on the one day a week. My savings are below the requirements for housing benefit

I am paying rent to my parents and live with my parents

As I live with parents and pay rent can I claim Housing Benefit

Have you asked the council?? And appealed the benefits 'decision'??

Thanks Kati, I only got the letter as of Saturday - I was not sure if living with my parents I can be eligible

This is my job seekers that has been stopped. I am paying more rent to my parents than I am getting from part time work

Living with parents is (I think) one of the times that HB would not be allowed :sorry:

You should definitely appeal the other benefits (JSA?) decision tho' ... you are eligible to claim at least SOME benefits if you work under 16hrs a week (and have savings under £6000) xx

You cannot claim housing benefit if you live with and pay rent to close relatives

My savings are slightly over what you said - I do not know what else to do - I am unable to get more hours in my one day a week and do not really want to stop as I am getting experience

The £6000 limit for savings cannot be appealed ... it's unfair, but unless/until you have less than that I don't think you'll be eligible for JSA

Have you looked at the entitledto website . It will give you an idea of what benefits you can claim, if any

Hi Lostfaith ...

I can categorically confirm that 'living with parents and paying rent' does not qualify for housing benefit as you are essentially a non dependent in their household and not subject to a commercial tenancy.

If, for example, the house contained an annexed property, that was self contained ( this could be attached or separate ), and therefore usually subject to a separate council tax assessment, then your parents could set up a commercial tenancy and you may be able to claim housing benefit, but again that depends on your age.

What you describe as 'rent' to your parents is essentially housekeeping/contribution for keep.

Please can someone help me with this appeal letter as I am also on less than the new living wage. The firm is small and has just not enough resources to keep me on full time.
