Can you be hounded for life to pay a court ordered debt?

  • Can you be hounded for life to pay a court ordered debt?

    I understand that there is a limit of six years to make a civil claim.

    However, once you have gone to court and a judge says that you owe the money can that judgement be enforced for as long as it takes to clear the debt? Or is there also a limited time before the debt is no longer recoverable through legal means?

    It may all depend on what the debt is for.

    With Council Tax - as long as the Council obtain a Liability Order within 6 years of it becoming due then there is no time limit on enforcing the debt.

    If for a CCJ then although the debt is always due - it does drop off your Credit File after 6 years but you still owe what is outstanding - then they should commence enforcement within 6 years otherwise they may have to prove to a Court why they have left it so long - very rarely granted.

      Thank you. So if they commence enforcement and continue enforcing the judgement they can keep on doing so indefinitely until they get their money?

          The debt is for breach of contract between two private parties.

          The only way it could ever be paid is through a charging order on the debtors property, but does that mean the debtor could be forced to sell their home and render themselves homeless? If they are in ill health and being made homeless due to being forced to sell their home can such an action be stopped? This has not happened but it has been suggested as a possibility as no payment plan offered by the debtor has been accepted by the claimant.

            If they get a charging order on your property, it cannot be turned into an Order for Sale unless you are not keeping up with the court ordered repayments. See http://debtcamel.co.uk/charging-order-sale/
