Name on judgement wrong, bailiff enforced...can i sue for refund??

    Council PCN issued against car.

    Car registered on V5 to ABC [GB] Limited.

    Judgement awarded against ABC [GB] Limited.

    Bailiff clamps car and wife pays because she thought she had to [I wasn’t around and she didn’t call me].

    There was no such legal entity as ABC [GB] Limited…this was a mistake when V5 was completed. Proper entity was ABC [UK] Limited.

    So the judgement was awarded against a ‘non-entity’?

    Does this invalidate the bailiff’s action?? I would like to sue the bailiff co and the issuing council for a refund.

    As you appear to have registered the vehicle incorrectly I don't see they have done anything wrong. By all means go ahead with what you plan but be prepared to answer charges that may arise from DVLA for registering it incorrectly. Probably best to let this one go but send off V5 with new name - although it will add an extra owner to the vehicle.

      I agree, the bailiff action appears correct as indeed was the penalty charge notice no doubt. The fact that you appear to have registered the car in the wrong company name suggests that you are the author of your own misfortune. I assume that you had every opportunity to pay the PCN?
