  • cabot financial and ccj help please

    hi i wonder if someone can advise me?
    i arrived home from holiday to find some court papers from northhampton county court business centre,the date of issue was 5/2/16. the claiment is cabot financial and the address for sending documents etc is reston solicitors.

    i rather stupidly ignored this as to be honets it looked bogus and i thought it was done by cabot to scare me into paying.
    well today 5/3/16 i received another saying that the court had awarded judgement for the claiment(in default)
    and now i have a ccj on my credit report.

    am i stuffed or is there anything i can do?

      thanks the debt is for £500 i believe it is SB but it might be easier just to take it on the chin and pay within a month to get ccj removed??

          If you can and want to pay pay and avoid it being registered it will unless you are fee excemt £155 and hassle to try and set it aside

            yes thats kinda what im thinking but thought id ask for advice here first,sometimes its better just to pay up.

                What is the debt, credit/store card /loan.
                You mentions possibly statute barred, do you know when

                1.The last contractual payment was made.

                2, The default date.

                3. Is this on your credit files? you can check Noddle free online.
                Statute barred debts arising from a simple contract 6 years with no payment or a written acknowledgment,

                The start of the relevant 6 year period can vary depending on the type of account.

                Don't give up yet!!

                  hi thanks for your reply,
                  my credit report shows the debt as a credit card.
                  the account was opened on 20/07/2005 and the default date is 09/08/2010 i cant remember or find any info on experian regarding the last contractual payment but i would imagine its several months before the default date.

                  ive just signed up to noodle to see if there's any more info

                    Could this be a Capital One Credit Card Cabot has a load of claims going through the system for these at present.

                    Does the claim form mentions the date the account was Assigned Cabot,

                      yes its capitol one,the claim form states it was assigned to the claimant (cabot) on the 28/09/2015

                        It sounds to me as if it is not statute barred as even if the last payment was 6 months before default that takes us to 9/2/2010 so the claim would have been just in time

                        Not only that but in order to try and go for a set aside (which is no certainty ) you are going to have to perjure yourself by making up a reason why you didn't respond , is it worth it for £500? If it was £5000 I might say you could deny receiving the claim but ...

                            well unless any ones got any last minute advice i think i will pay it tomorrow,just to confirm,if i pay within a month the ccj will be removed,is that right?

                              Within 28 days then the CCJ won't be registered on the register of judgments. Retain proof of payment and ask the claimant to inform the court as soon as you have paid it.
