Re: Parking charge from Excel Parking

Please help.... I don't know my next step.

ive applied online to the court for help with fees and have a reference number.... I gave the N244 form sat in front of me, but don't know what to say?

i also can't find the original letter that I posted on here back in March. I have the image but it has no address on it... So therefore no proof?

It can also be reduced to £100 if you chose to file the set aside by consent (BW Legal/Excel agree to it). If you show them they wrote to you at a new address before they lodged a claim at an old address.

If you pay it will be over, obviously, but be aware if you have taken longer than 28 days since judgement was handed down that this will be recorded at the credit reference agencies for 6 years.

Re: Parking charge from Excel Parking

Im sorry, I must not have seen that in my blind panic!

Is is there a template letter I can use to write to BW Legal to ask for consent to set aside the judgement?

also can I use the CPR 31.14 request letter in order to get details of the original court papers?

          Not really.

          Dear BW Legal,

It has come to my attention that your client has obtained a default judgement against myself after serving courts papers at xxxxxx when they knew i lived at xxxx as evidenced by the fact they wrote to me at this address on xxx, a copy of this correspondence which i attach/ include (delete as appropriate depending on whether you write or email).

As such i will be applying to set this default judgement aside and invite you to consent to the application in order to save on costs, which i will be seeking from your client in view of them using the wrong address.

As a firm of lawyers you will appreciate i must now act swiftly so i look forward to a speedy reply with 3 days of receipt of this email/letter. If i do not hear from you i will proceed without delay.

          Yours sincerely

Thats perfect thank you. Think I am going to both email and post recorded delivery.

with regards to the previous letter I recieved from them, I can't find the original copy only the image to which I have posted here which does not show the personal details.

The previous letter was also from BW Legal not Excel parking Ltd
