Re: Claim against Barclays / Firstplus & Elderbridge Ltd

    Hi Fred,
yes its 25 years, yes arrears and additional amount.
The sale wont cover the debt either, is it worth me selling with all the costs incurred or just hand the keys back to my first charge mortgage provider?

Hi Spyker. have you approached your local authority housing options team for free advice?

Asked to be referred to NHAS - who have officers that specialise in mortgage cases. (all advice is free) NHAS will go through your case with you and make sure everything has been explored to try keep your home (or not, if this is the best option). NHAS can negoiate and advocate for you.

Like all the others in here I too have had similar happen to me.
Loan taken out in 2007 for 39K, wife decided not to contribute when she walked out in early 2009
Taken to court late 2009 to be patronized by FP solicitor working for Eversheds. Ordered to continue payments at agreed amount.
Kept making payments to save being repossessed and then FP stopped taking the money in 2013, to which I asked why. Then then told me because of the PPI claim I had with them. Then when that paid out on that they decided to send my wife half of the 8% statutory payment because 'her name is still on it' and her stance is Not paid, wont pay.
Had Elderbridge take over this in January 2016 and basically hunted me day after day to the point where I have had heart attacks that have resulted in open heart surgery and a triple heart bypass. Wrote to them before the operation asking them to leave me alone for a while - they didnt. operation was 22nd Dec 2017 - discharged 28th Dec. Rung up 3rd January by a low life requesting I pay more. Explained Id written to them had major operation. Didnt seem to matter.
They have ruined my life, my health - and now they persist in taking me to court for the house.
I am at the point of putting the house up for sale and getting out. I literally cant take anymore. No help from anyone anywhere in site. ((((

Well, all I am at liberty to write is, that these people do not always win in court. There are plenty of things they have/may have done wrong which may be considered in a court if presented correctly.

The last course of action is repossession it only happens when there is no other way to resolve the issues both parties face & there is much to take into consideration, there is much on this site including the disclosure to read.

I agree it is shocking what these people do but, not the end by any means, I know from experience for sure on that. Its down to the individual to decide whether to fight or give up, I know which way I prefer but that is not to suit all.

Re: Claim against Barclays / Firstplus & Elderbridge Ltd

Thanks for the comments Fred. Unfortunately I don't think I am prepared to sit in a judge's chambers or court room for a second time to be spoke to in a condescending manner when the judge for what ever reason is clearly siding with the lenders who have done nothing wrong, unless you count manipulating their policies to gain maximum interest regardless of the BoH Interest Base Rate position or even supplied so much as a regular statement. That's what happened before and it is nothing short of pure frustration and the lack of any legal right on the customers side. As far as Judges are concerned 'you signed it, its crap I know but pay up or they will come for it and we will assist' . Everyone knows about the devastation First Plus...or lets call them by their right name BARCLAYS BANK have caused to countless thousands of people who have been through the same or already lost their homes. No wonder Carol Voderman would not renew her contract years ago. Not that that's any consolation. Barclays.....(and Voderman) all washed their hands of it to Elderbridge who were interestingly formed a short time ago but somehow have a large amount of capital to buy all the 'bad' loans from Barclays at a massively reduced rate, then come chase all of us who have be wronged for years. Well some of us don't have the means or insight in the banking and court world to fight these parasites. I wish I did but I don't. Some people might see this as giving up. Take note I went to court almost ten years ago and didn't give up. But there is only so much you can take. Without proper information, and by that I don't mean the odd word here and there on the internet, I mean proper grounded legal evidence to prove we have all be wronged and something needs doing from a higher level - what chance do we really stand!

I know of several who are in a much improved position by selecting the right argument in court, most of the key issues are on this site. I had an order from 2008 set aside based on the issues I raised.

                    Hey man,
Sounds like they are strengthening their position and confirming your who you say you are.
Elderbridge are like a dog with a bone until they take you to court and go in for the kill. Before Elderbridge, Red Castle and Gothia where a joke, they never checked up on you and I was paying £200 a month. Now I'm paying £588 these guys are brutal don't mess with them.

By all means do not underestimate their legal rights on these loans but, they have also sailed very close to the wind on several matters which are being dealt with.

                            Thanks
