    Hi All,
    Hoping someone could advise here?
    I'll try to keep it short. I have a PCN from Smart Parking for overstaying my welcome by 14 minutes. They have sent me photos of my car entering and leaving. My defense was that I had not been able to use coin payment as it wouldn't accept my coins. I therefore used the Ringo service and phoned to pay. It took me three attempts which I have evidence for,(mbl phone calls statement and times) as I had to register my new car and the automated voice service kept failing to hear my registration plate details . Eventually, on the third phone call I managed to register the car and paid for two hours parking.
    I returned to the car park just under the 2 hour period. However I received the PCN for being over the two hours as they had charged me from the moment I entered the carpark and not from the point that I actually managed to pay via Ringo.
    I appealed to them and failed and I also appealed to POPLa and failed.
    I feel very strongly, that Id made several attempts to pay using their automated phone service, and yet I'm charged for being 14 minutes over!
    Should I refuse to pay the £100 penalty and force them to take me to small claims court?

      Probably unless you know the carpark owners and ask them for help.
