  • Lowell Financial, Bryan Carter and now Fredrickson International - very confused help

    Hello. I have posted before in regards to Lowell Financial and Bryan Carter working together to take my husband to court for Credit Card debt. I received lots of help and advice, thank you, and I have sent the courts my witness statement and I have also sent a letter off to Lowell Financial asking them to prove the last credit on the account in 2009 as I am expecting it was an admin adjustment not an actual payment.

    Yesterday Lowell Financial sent me a letter 'thanking me for my recent correspondance' - which would have been me asking for proof of payment - They don't address my enquiry just advise me that the account in question is being managed on their behalf by Fredrickson International LTD and advise me to contact them.

    This is the first time that name has come up, previously I have only been told about Lowell Financial Ltd being the claimant and Bryan Carter being the legal representative.

    Do I have to send a proof of payment request now to Fredrickson International Ltd? Or because the only correspondance sent to the courts is through Bryan Carter and Lowell Financial they should send me the information I have requested?

    I don't want to be given the run around? Are they delaying? My husbands court hearing is on the 15th March 2016 . I have phoned the court to see if the case is still live and they have advised me it is.

        I believe it is left hand not knowing what right hand is doing. It is likely to be a automated template letter sent out by Lowell. Frederickson is a part of the Lowell group. Personally I'd just file it away - you haven't been sent any copies of documents yet have you ? Freds won't hold any other information than Lowell do, being the same people in essence. You MIGHT at some point get notification of a change of solicitor though as Lowell are taking back cases from Bryan Carter and litgating themselves through their new solciitors firm ( Lowell Solicitors).

        When does the court order for the hearing state that the Witness Statements are due to be filed ? Usually it's 14 days before.

            I have copied the most recent correspondance from Lowell Financial in full below.

            Witness Statements had to be in by 5th February 2016 . I received on the 20th January 2016 Lowell Finance ltd witness statement along with the documents I requested in August 2015.

            On reading the documents I queried the last monetary figure, sending Lowell Finance Ltd a letter on the 28th January 2016 requesting they send me proof that the last monetary figure was a customer payment and not an internal adjustment. The letter below that I received yesterday was, I presume, in response to the monetary query. Do I have to send Fredrickson International the payment enquiry now or as Lowell is the claimant should they deal with it? As Lowell has already sent their Witness Statement in can they now add a 3rd party (fredrickson) into this? I don't want to get to court in a few weeks time and find I have done something wrong so they win on a technicality.

            This is the letter from Lowell Finance and it says:

            Dear Mr xxxxxxx
            Thank you for your recent correspondence.

            We are writing to advise you that this account is being managed on our behalf by Fredrickson International Limited.

            Please contact them using the details below:
