    The OD would probably have been implemented via a " letter of facility " giving the terms and conditions of the OD. There would have been " a demand for immediate payment in full of all outstanding sums" and or a Final Demand would have been issued.

    What documents are mentioned in the POC you would expect those to be produced.

      Ok thank you -

      Don't remember getting anything from the bank except the " letter of facility "

      In the POC they state: terms/conditions of bank account and Notice of assignment, both of which I asked for but never got.

      Any point in sending a full and final letter for a reduced amount?

        UPDATE:

        Seems like Hoist have discontinued as I received a letter from HC yesterday with the Notice of Discontinuance.

        Not going to count my chickens yet, I guess I will phone the court and check with them next week to make sure? - Just concerned it's a plot to get me to not turn up at court - LOL

          It's all over within a few days you will get a notice from the court. Clearly they have failed to find and documentation Well Done, it's a good result!

            Thanks, Well lets hope so.

            After many letters sent to HC they never sent me anything and the court date was in 10 days too, I had filed and served the WS and my documents - F all from HC until this letter.

              The claimants and their solicitors abuse the court system by issuing claims when they know full well that they don't have the documentation to back up the claim, they just hope people will be frightened by a court claim and pay up.

                It is terrible that they do this to people, they should not be allowed. It causes undue stress, wastes time and money for people. Mind you Royal Mail has benefited from the extra post I have sent :tinysmile_twink_t2:

                  Update:

                  I never got a letter from the court to confirm the discontinuation, but I phoned them up a few days before the court date and they confirmed that the case had been discontinued and no need to attend.
