  • Smart Parking Ltd. - won

    Hello,

My girlfriend was driving my car and parked on ASDA car park, where see has received a parking ticket for staying to long, Please can some one help to see if we are liable? There where plenty of parking spaces still left available, and it took her over forty minutes to leave the car park due to bad traffic on the main road that it was exiting on too.

I have attached the letter we received today, if that helps

          Re: Smart Parking Ltd.

As well as appealing you should speak to the MANAGER of the store.

          Dear Sirs,

I, as registered keeper, wish to invoke your appeals procedure. The driver did not see any signs and was a genuine customer.

It is noted that your notice to keeper is fundamentally flawed when compared to PoFA 2102 schedule 4 para 9.

Should you reject my appeal please supply a popla code.

          Yours etc

If/when you get a popla code please let me know.

          M1

              Re: Smart Parking Ltd.

I appealed on the website but still not had a response or a confirmation email of my appeal? Can they deny I've appealed it? I would have thought to have a response by now

                  Re: Smart Parking Ltd.

The reason they hadn't responded is they just cancelled the ticket: -

                  Appeal - PCN TC39604020
The Parking Charge Notice (PCN) has been cancelled. No appeal is necessary. If you would like to contact the Parking Office regarding this Parking Charge Notice please call the office on 0845 230 3081 and select option 4.

Thanks a lot M1 and Kati for all your help!!! :tinysmile_grin_t:
