  • Civil Enforcement Ltd - county court claim, is this letter genuine?

    Hello

    Received this letter, not sure if this is genuine? It is a 4 page document, some double sided. All seem to be photocopies - including the county court stamp.

    It is regarding a parking ticket by post that happenned in June 2013 which IIRC wasn't sent from CEL but another parking enforcement company. It was ignored. No other correspondence came through until CEL sent a letter in Dec 2015. This was ignored too. Now this has arrived, I have blanked out a few details - there is a Claim No.

    Is this genuine? How can i check the Claim Number is registered with the court?

    course it is a genuine N1 county court form you need to acknowledge it on MCOL there should be a reference number on another sheet to acknowledge it on line then as k peeps for advice by giving them details of incident etc

      OK thanks, having read previous posts about CEL I thought it could be one of their fake ones.

      Looks like I am in the right section then!

      Details are:

      Car was driven into a temporary carpark, just to park up whilst my wife got some coffees. Noted it wasn't free, so car was driven straight out and then parked on the entrance road to the carpark (no marked bays) for a few minutes. Received a PCN from a parking company that we can't remember, was binned. Then a year or so passed and CEL sent a letter, again ignored. Now the court letter in the opening post has been sent.

      Its a notice to keeper, which is my wife. She wasn't driving at the time.

      No other documents have come through yet. Do we wait until they send them through before we respond?

        First thing to do, as already said, is to acknowledge it. They should be sending additional details within 14 days of issue date +5 so you should know exactly what they are claiming for and hopefully some documentation or reference to documents. If the details are not received within that time frame then you can complain to the court and get the claim withdrawn

                Hello again, update is there has been no additional documents sent through. Issue date of the claim was 20th Jan, the particulars have not been received.

                Today is 14 days + 5

                  Phone them and ask where they are.

                  The period for filing a defence

                  15.4
                  (1) The general rule is that the period for filing a defence is –
                  (a) 14 days after service of the particulars of claim; or
                  (b) if the defendant files an acknowledgment of service under Part 10, 28 days after service of the particulars of claim.
                  (Rule 7.4 provides for the particulars of claim to be contained in or served with the claim form or served within 14 days of service of the claim form)

                  The defence due countdown hasn't started as the particulars are outstanding.

                    Called CEL, there are 2 numbers on the County court claim form, one is a 24 hour payment line with other options (if bailiffs at door, or car impounded etc), but none to speak to an operator. The other line is the legal team, which cannot take calls but an option to leave message on answerphone.

                    So I called the county court and asked if they had received any particulars, they haven't. So called the CEL legal number, left a message leaving their reference number, telling them particulars haven't been received by defendant or the court, reminding them it is over 14 (+5) days from date of issue and I left a contact phone number.

                    When I was talking to the court, the person I was talking to said (in their opinion - not advice of the court) I should get a defence in by Feb 22nd irrespective of receiving particulars or not!

                      Well it would be easier to file a defence but as you have no statement of claim to defend how would you do so ?

                      The office staff have no legal training (neither do i to be fair) and are not actually allowed to give legal advice.

                      They are incorrect.

                        (2) Where the defendant receives a claim form which states that particulars of claim are to follow, he need not respond to the claim until the particulars of claim have been served on him.
                        Defence, admission or acknowledgment of service
                        9.2 When particulars of claim are served on a defendant, the defendant may –
                        (a) file or serve an admission in accordance with Part 14;
                        (b) file a defence in accordance with Part 15,
                        (or do both, if he admits only part of the claim); or
                        (c) file an acknowledgment of service in accordance with Part 10.

                            To be honest i'd just mail them then contact the court and ask a note be placed on the file that you have not received the particulars of claim within 14 days and that the phone number on the claim form does not allow you to speak to them but nonetheless you have written to them, just in case they apply for a default judgement which they are not entitled to do. Mistakes can happen though so be prepared and they can be fixed a hell of a lot easier in the event.

                            Keep notes of all correspondence.

                              It is common practice now for them to promise Particulars in 14 days but not send them. You'd better put in a defence of some sort before the 28 days is up.

                              Put together a page which lists the timeline of events

                              1. You are the keeper of car reg xxx

                              2. The driver parked at xx on xx for xx mins

                              3. No signs were present and if they were there was insufficient detail on them

                              4. The period you were there was insufficient for you to be able to read, understand and agree terms and you put CEL to strict proof the signs were in the location specified.

                              Build it up like that from other cases.

                              The key to this will be the pics as the DVLA insist that PPC must have dated and timed pics with the car, the VRM and the signs in view. That's what CEL need to produce which they are unlikely to have.
