  • Howard Cohen - Notice of Pending legal Action

    Hi all,

    I have received a letter from Howard Cohen regarding a Lloyds Bank overdraft debt that previously was being chased by Robinson Way ltd. The debt defaulted December 2010 and so I guess it will be Statute Barred in Dec 2016 (i.e this year).

    Howard Cohen state that if I dont make a payment arrangement within 10 days (already passed, letter dated 02 Jan 2016), they are instructed to issue proceedings.

    First question is - Do Howard Cohen USUALLY go for a CCJ straight away or do they chase several times first/fizzle out?

    I have my bank statements for the last 7 years and 2 or 3 years ago considered claiming back all the unfair charges - which are a sizeable portion of the debt itself (debt £6500, charges £2500). I didnt bother as it would only reduce the debt, not clear it, and would just stir up a hornets nest.

    I dont know if I have the strength to start the whole 'prove it' and cpr(?) letters. But will if there is a high chance Howard Cohen are ******* and will slap me with a CCJ asap.

    Any experiences or constructive advice would be really appreciated.
