  • Waranty issue when a company is dissolved but reappears....

    Hi. In 2012 I bought some machine equipment which had a 3 year warranty. Unbeknown to me, the supplying company was dissolved and assets bought by another company..(same people). They kept the brand name, same staff, premises and so on.
    I subsequently tried, after one year, to claim for various faulty parts but was told that the warranty, for all but one part, was for 1 year, not 3.
    I eventually accepted that I must have gotten my facts wrong.
    Then, as my so-called 3 years warranty was expiring, I came across someone who was gushing in their praise for the company and stated that their 3 year warranty had been honoured... with bells on.
    I then found an owners manual, given to me at the time of purchase; it was emphatic about a no quibble 3 year warranty on every part of the equipment.
    The company initially agreed to supplying some parts when I confronted them with this information, but then backtracked.
    I eventually began small claims court proceedings and it was only when I received their defence papers, that I found out that the company had been dissolved and reborn under a different trading name.
    They admitted supporting previous customers within reason but maintained that my warranty was never for 3 years.

    I understand that my warranty is most likely worthless given the change of companies, but I wonder if the fact that they have blurred things by honouring some claims, might hold some sway with the judge.
    I did try to resolve this with the company and also agreed to mediation but they would not play ball.
    What I fear, is a sympathetic judge who agrees it is all a big shame, but whose hands are tied by company law.
    I have paid my court fees and the hearing is in under a couple of weeks.
    Does anyone know of this type of scenario. Any advice is very welcome~

    it happens, especially with small companies, that's why i always prefer big name companies
