    Hi Fellow members of the forum,
    I am need of help and support. Recieved a CCJ Claim form yesterday by Moritimer Clarke Solicitor. on behalf of Cabot. The debt seems to be pretty old and maybe dates back to my student days when i was having financial difficulties.

    I am not sure if the claim is SB. The claimed amount is 1255 plus 150 fees. I am absolutely broke right now to even pay anything towards it. Could anyone suggest.

    Hi, please read the stickies on the procedures required. You have to register with Money Claim Online (MCOL) to set your defence. You then have to send MCS a CPR request for information on this debt (plenty of templates to copy from here) SEND RECORDED DELIVERY and a SAR request (template) to the Credit Card or Bank. Both will require postal orders. Mostly as you will see from the Forums Cabot/MCS are basically fishing/scare-mongering in the hope you'll pay up. You do have to follow procedures in any case .             CCA REQUEST TO CABOT : LETTER DRAFTED == £1.00 P.O. signed on back for CCA purposes only send Recorded Delivery
            CPR REQUEST TO MORTIMER: LETTER DRAFTED no fee send direct to them RECORDED DELIVERY

              1. What is the default date on your credit files? You can check Noddle Free Online.

              2. When did you make te last payment and / Or written acknowledgment of the debt?

              What did you request via CPR 31.14? The agreement, the notice of assignment, notice
              of termination?

              Send the requests by signed for post Cabot has 12 + 2 Working Days to comply with the
              CCA request, time starts the day they receive it so check the delivery date and keep a note.

                Just checked the dates,
                The default on credit file says sept 2010.
                the last payment was made on July 2010
                In the CPR i requested the agreement only
                I will post them tomorrow

                          The update in 2012 I suspect is when the account was sold.

                            It says credit card from Lowell Portfolio.

                            I dont think i paid anything to anyone in 2012. Its should have been the same as Capital one.
