    Particulars of Claim:
    By an agreement between Capital One & the Defendant on or around 12/01/2009 (the agreement) Capital One agreed to issue the Defendant with a credit card. The Defendant failed to make the minimum payments due & the Agreement was terminated. The Agreement was assigned to the claimant. THE CLAIMANT THEREFORE CLAIMS 685.01

    Have sent: Sent a CCA request, Sent a CPR 31.14 request

    On the 5/1/16 we rec'd a letter dated 8/12/15 with a threat to start proceedings so we immediately sent out the two letters (CCA req and CPR 31.14 req) as it has obviously been stuck somewhere.
    Today on Thu the 14/1/16 I received a Court Claim Form Claim No. C3CD0738 Dated the 11 Jan 2016, and ALSO a letter from Mortimer Clark Solicitors dated the 12/1/16 with ref to Cabot Finance, Claim No. C3CD0738, "Thanking us for letter dated 7/1/16, acknowledging the request for information and saying that they have asked their clients for the information and will come back to us. In the meantime, the matter has been placed on hold and no further action will be taken."

    Here We go again !

    This one is my boyfriends, he now has serious health problems, so is unable to work.

    As we have got the court claim form and also a letter "saying that it is on hold and no further action will be taken", should we still acknowledge receipt of the claim to the court along with a copy of the letter from Mortimer Solicitors saying that the action is on hold, or what should we do.

    They have already been sent the two letters before we got the court claim.

        Hello Little B

        Yes follow the court process acknowledge service and intention to defend in full.
        Their "on hold" does not affect the court processes.

        CCA request sent to Cabot?

          Many thanks Nemesis45, we though we should carry on with court etc, as we thought their "on hold" was worthless.

          CCA letter and £1 standing order sent to Cabot as well as the letter to Mortimer Clark Solicitors.

          Thanks for your quick reply.
          Lucklily after winning my case - this time we are more level headed about it, and not in a blind panic. xx
