Small Claims, Tricky case.

I need to take out a small claims against an EU Citizen (Italy) and has/had a British Bank Account. The issue is due to a Council Tax Refund that was incorrectly paid whilst there was still outstanding dept with the council.

I wish to recover these refunds so i can then pay back the council. I have been in-communication with the defendant, and i know he's receiving my messages. However he is refusing to communicate with me of the council.

I addition he has a business website that works with other companies as a affiliate, from which he would be gaining a income.

Also given the nature i feel that a third party debt order would be required or a European Small Claims.
