    I've acknowledged the claim and prepared a CCA request which I will post tomorrow. I'm also thinking of sending the CPR request, but am unsure what to ask for, the "Contract" and the "Assignment"?

    I'm certain this is Statute Barred. I have neither paid nor acknowledged this debt in almost 10 years.

    What is the process for defending this claim on that basis?

        Good evening. welcome to LB,

        CCA done that's fine.
        Yes CPR 31.14 to Reston. Please type up the Particulars of the Claim in full we can then sort this request.

        What is the value of the claim?

        Is this a loan or a credit card?

        Is this still on your credit files?

        Statute Barred is a complete defence and we may be able to finish this before it gets anywhere near a judge.

        If what have posted as the particulars of claim is all that is said then I guess they have very little to backup the
        claim.

          The Particulars of the Claim are exactly as typed above. That's it.

          The value of the claim is as follows:

          - Amount Claimed: 5785.25
          - Court Fee: 410
          - Legal Rep Costs: 100
          - Total 6295.25

          It was a Credit Card.

          My credit files have been clear for approx 4 and a half years.

          I've been going over my bank statements for the last 6 years and cannot find any reference for any payment, just in case I'd forgotten; I've found nothing yet.

            Good morning, in my opinion the debt is Statute Barred I will if you wish provide a draft letter to this effect which does
            not admit any liability for the debt and should squash this quickly.
