    [MENTION=55034]nemesis45[/MENTION] will get them posted signed for today and then i guess it's a waiting game to see what i get in replies. Is it 28days i have fromm date of claim form though to submit defence just don't want to forget time scales with it being over Christmas ect.

      It's best to get docs in early over the holiday period all time scales are Calendar Days.

            [MENTION=55034]nemesis45[/MENTION] Happy New year
            Since our last message i received a "notice of claim issue" letter from lowell solicitors just after christmas. Basically asking me to call them and arrange to start payments with them also saying...
            "if you do not contact us within the time specified we may enter a ccj against you which may remain on your file for 6 years ec ect..

            Anyway should i be doing anything else, have not received anything else yet but may be on way what with the xmas holidays ect but was worrying about replying to the court as can not remember how much time i have to do that and what i should be saying.

              No agreement supplied after CCA request? CPR request. Posted Dec 16 ?

              If not then the debt is unenforceable UNTIL the agreement is supplied.

              OK strange letter seeing they have not complied with the CCA request, ring
              the court and find out what if anything Lowell Has / has not done.

              Then come back to me please.

                nothing else received apart from the letter mentioned above,although just checked the letter and it is dated 15th december but i didnt receive until 29th december.....and yes i posted the requests on the 16th by first class signed for delivery.
                will give the court a call tomorrow afternoon after work,should i just literally ask what Lowell has done,or should i ask anything specific?

                  Ask what actions/applications has the claimant or its solicitors have made.

                      Will call the court tomorrow,and take the number with me in case i get delayed at work lol

                          Still no letters or documents received today and i have been trying to call the court on the number provided 03001231056 most of this afternoon but can't get through just keeps ringing and eventually cuts me off? i Will try again soon but have no idea of when they will close but if no joy i will try again tomorrow. Just getting a bit worried when i should be defending the claim online?

                            Notice of Claim issue is what the court send to the claimants to confirm the claim has been issued. The claimants will have sent it to you just to intimidate I suspect. They can't just enter a CCJ against you, as they well know, anyway you have responded to the claim with letters and acknowledging so really don't worry about that at all.

                            If your claim is date 15th December ?? then your defence needs to be in around 15th Jan.

                              Court office for public access are usually open 1000hrs to 1600hrs Monday to Friday, but they are extremely busy and short staffed.

                                thankyou [MENTION=55034]nemesis45[/MENTION] [MENTION=6]Amethyst[/MENTION] ...My claim form from the court was dated 10th december but i didn't receive until 12/13th and i acknowledged it online on the 15th after advice from nem, also sent CCA and CPR request first class signed for delivery on 16th and as said nothing has been received...so is that still the 15th january i have until? wasn't sure if it was 28days from 10th or 15th? p.s i will try not to worry lol
