    Hi All,

    Debt cost: £1,360 plus fees

    Brief background:
    I received a claim from from Carters on behalf of Lowell who are dealing with a alleged Lloyds overdraft
    To summarise I completed the online Moneyclaim procedure and filed my defense on the 11th November citing that Carter needs to provide evidence I actually owe this debt. It appears to be just in time and not SB so it will come down to whether or not they can provide the paperwork as to whether or not they get any money out of me.


    I am trying to workout what is occuring as it's now obviously December and I've not heard nothing it will be a month next week that my defense was filed.
    I tried to speak to Carter who said I need to contact, Lowell said it's actually being handled by Fredricksons then the idiot I spoke to at Fredricksons transferred me directly to Carters who this time then told me they didn't know anymore.

    So I'm lost really and I didn't even know Fredrickson was even involved until now.

    Is there a time limit that the court or the claimants have to adhere to in order to reply to the defense request or decide to drop the claim? As far as I am concerned I've defended myself and now it seems like I've got to wait on the claimant for their next move given them plenty of time to go back to Lloyds and look for paperwork which is obviously not what I want.

    Hi All,

    Just an update on this one this claim was struck out earlier this month by the district Judge as the clowns at Lowell not only failed to disclose any evidence I owed the debt they also didn't turn up for the hearing.

    What's my next steps? The debt is 6 years old in a couple of months. It took me a lot of time and effort to defend this claim including lots of wasted hours on the phone to them and their various companies trying to get any evidence that I owe this money.

    What is the best way to proceed with claiming costs against these?
