  • Please advise - I really need your help

    Hi everyone I am Danni I'm a newbie.

    Sorry to bother you straight away asking for advice but I am in a sticky situation.

    So I had an issue with an online gambling website and long story short we had heated discussions about whether I had won a bet.

    I was told by them that I could take them to Court and they told me their address for Court mail - it is in the UK.

    I served them using the money claim online service, then waited. They acknowledged, but did not get a defence in before the deadline and I asked for and won a default judgment.

    I called the county court bulk centre to make sure they had not received a Defence that day (this would have meant the default was reversed) and they had not - so the default judgement stood!

    I was delighted. It meant I could book a late Summer holiday with my boyfriend. We have not been away this year.

    I spent the £600 I was awarded on two non-refundable flights, four days after the default win was sent to me.

    The day after I received an application by the Defendant.

    It asks for the default to be overturned. He states he made an error in his diary, hence his not sending the Defence in on time. He states I served the wrong address and company and should have started a legal claim in Gibraltar (although the UK address that I used was the info given to me by the company itself) and then he states the claim is easily defendable which is bs.

    I don't know what to do - is this fair? Is it likely the default will be overturned? I am relying on the £600 for this holiday, otherwise we cannot go and I am effectively £600 out of pocket.

    On another board someone stated that there are now rules about strictness in Courts and Court proceedings and that deadlines must be obeyed.

    I am very upset. Can anyone help me figure out the likelihood that this will be overturned, and what to say at an application hearing if the app to overturn the decision goes ahead?

    Hi and welcome
    It is basically up to the judge to decide if the Defendant has a valid defence to this regular default judgement, and if the application was made in time.
    If you did take action against the wrong company in the wrong country it most likely IMO to be set aside.
    So we can check their defence could you post up EXACTLY who you named in your claim, and the site on which you were gambling?

      It was a small company named XXXX (obviously I'm replacing the actual name with XXXX)

      They are called XXXX and their website is XXXX.com.

      On Companies House they are called XXXX and their address is in London.

      Their staff member also told me the above was for service of my court claim. I am obtaining a copy of this call from them as it was recorded.

      HOWEVER...

      They now state that XXXX is their UK based company for retail, not internet transactions, which is called XXFSXX and is based in Gibraltar.

      Hmmh.

      Their website does not really state the truth in the above paragraph one way or the other, it actually features the London address more than anything.

          When you won the bet and communicated with the company, did you do that by email or over the phone?

          Most online gambling outfits are registered in Gibraltar for tax purposes but they usually have offices both in Gibraltar and the UK. From what I'm reading above, the whole thing sounds a bit dodgy. :mmph: You disputed the bet and instead of arguing with you about having won it, they told you to take them to court and provided you with UK details so you'd naturally issue a claim at that address; they don't respond and then argue they are based in Gibraltar because it was the wrong address and jurisdiction to start with. However, the UK address would be one of their offices, so someone there should have received the claim. They seem to have received the judgment OK. At the time of acknowledging, they could have disputed jurisdiction if that was the case.

          I'm beginning to smell a rat here, and, given the nature of the business, I wonder whether they make a habit of not paying winning bets and then telling people to go to court, then providing the wrong details. :confused2:

              Thing is, if you don't tell us who they are, we can't really look into this company.

              Although naming individuals on the forum (with a few exceptions such as well known names) is usually not recommended, we do name companies so we can explore things further.

                That would be because of tax and gambling laws. It isn't to avoid paying out on bets...

                I am a bit baffled about how there can be a dispute about whether you won an online bet. Did you get confirmation that the bet was placed? Did they deduct the money from your account? Are they suggesting the bet is void because of some sort of force majeur clause?

                            Yes - but they're stating that their online getting operation is based in Gibrsktar and called something else - even though I am dealing with problems based on their not answering phones in the UK and not dealing with emails that their UK people should be answering.
