  • Back dated JSA claim

    Can back dated claims be appealed? I was offered a job but it fell through can that be a good reason for a back dated job seekers allowance claim.

    I applied for a role which was supposed to start in August 2015, the role was put on hold till end of August 2015 I found a short term project in between those dates till that other role on 1 September would start, the agency did not tell me till the 17 September it was no longer in existence. I had three job interviews in between 28 August and 17 September - I kept the job advert as evidence.

    When do you want it backdated to?
    Did you do a 'rapid reclaim' or just make a claim for JSA?

    You can appeal any decision you do not agree with (although there's no guarantee your appeal will be upheld). There are certain steps you need to take in order to do this - https://www.gov.uk/social-security-c...pport-tribunal

    Ask for a Mandatory Reconsideration
    Write to the department that gave you the decision and say you want a mandatory reconsideration - the address is on your decision letter.

    You must explain why you think the decision is wrong and include any evidence you have to support this.
    this must be done within one month of the date on your original decision letter!

    If the decision is not changed at this time, you can then appeal to the tribunal
    Your original decision will be reconsidered - you’ll get a ‘mandatory reconsideration notice’ (sometimes known as a ‘written statement of reasons’) telling you whether the decision’s been changed. You can appeal to the tribunal if you’re still not satisfied
    Again, this must be done within one month of the date of the MR decision letter!
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

      Thanks Kati. I asked for it to be back dated to the 1 September, it was a brand new claim. I started it on 17 September when I knew I was not going to that other job, I chased agency and no reply, and I kept job advert as proof.

        definitely put in an appeal ... if you had no income/were eligible for JSA at that time you should (ray2 get it backdated

          Now got the form Kati I was wondering for some help on how to explain a good reason I didn't claim earlier. I have the advert of the job I was going to goto at end of the last role I was in. It's a JSA510/11 form

          I have not got the original decision yet but think I should fill out the form.

          Something along the lines of

          "I was working between ..... and ..... in .... two weeks before this project started I was offered another role to go to immediately after it finished. I enclose where I worked between .... and .... and the job advert of the role which was due to start after it.. I found out day before I made my new claim on .... the role fell through".
