          Hiya, When's the court date - end of May ?

          Has the claimant paid the hearing fee do you know ? ( just as the letter says to pay by 16th March ) so worth checking with the court if they have or not.

          Then you can get on with your witness statement to be exchanged by 4th May. There's two ways it can go really, they can either send their witness statement with all the documents - or they can discontinue. Regardless of what they do you should ( after checking with court about the hearing fee ) put together a witness statement ( which really won't say a great deal more than your defence - have a look at some example WS's here http://legalbeagles.info/forums/show...ness-Statement) If you want to have a draft we can give you a hand with it.

            Standard order for this stage of the claim.

            I see that the order is dated a month ago when did you receive it?

            We don't know if the hearing fee has been paid?

            Has the HMCTS Small Claims Mediation Service contacted you yet.

            I think you should phone the court today to find out what exactly is the status of the claim.

              Hi, Thanks for your replies [MENTION=6]Amethyst[/MENTION] [MENTION=55034]nemesis45[/MENTION] . The court date is for the 5th of May. I will get my husband to call the court as it's all in his name to check if the fee has been paid. He did hear from mediation before receiving the form but was unable to go ahead with this due to not having received the requested documentation. We will crack on with drafting a witness statement depending on what the court says. Am I right in thinking that if the fee has not been paid nothing will go ahead? Just wanting to confirm this...

                OK so we rang the court. It seems that the fee hasn't been paid yet. The person at the court seems to think that there is still time for it to be paid though! When we mentioned that the documentation shows it should have been paid by 16/03/16 we were advised to email the court about this. Any idea what we should say?

                  A polite reminder to the Court Manager if poss with a copy of the letter re the fee.

                    So it's been a while since the last update because we had confirmation from the court that the case had been struck out due to Lowell not paying the fee. However we then got a letter advising it had been reinstated and Lowell had until yesterday to pay. Just called the court and they have paid it! No explanation for the reinstatement and no communication from Lowell for over 6 months... any advice please?

                      Hello again Titania.

                      I suspect than since Carter's business went pear shaped Lowell has possibly instructed a new solicitor or are using their in house clowns Lowell Solicitors Ltd.

                      I would expect you to receive formal notice of a change of legal representative very soon.

                      What if anything was provided by Lowell/Carter in the past?

                        We did get a letter advising a change of solicitors almost a year ago. The only other thing we have ever received is the standard pay us or else letters. They never provided any of the documentation we requested.

                                So we have now received a general form of judgement or order, form N24, with a court date of 27th of March. It is asking for statements and documents. We have been here before I'm sure, should we just use the same statement? We have had no communication from Lowell or their solicitors so far.
