Service of Claim Form

Hello, I could do with some help regarding the procedure where service has not made upon the nominated solicitors!

I have inherited a file where we have issued proceedings and the Court has served the papers however the address provided for service on the claim form was that of the Defendant himself and not the solicitors who have been nominated to accept service.

Is it possible to now serve upon the solicitors and would this mean amending the original claim form or submitting a new claim form? The four months following the date of issue have not yet expired.

Any help would be much appreciated!

Officially, you are required to pay the fee but if you sent it the day before then you might get away by not paying the fee. You need permission form the court to amend the claim form and its not a guaranteed right. If you are amending the claim form you will need to several things:

1. three copies of the amendments
2. strike through anything you are changing in red ink
3. insert amendments in red ink

I'm sure i came across a guide on this somewhere on the forum that explains this.
