Taking Landlord to Small Claims - Counter claim received

    Apparently not!

    We are not out of the woods yet.

    Today I received a claim from the Sheriff court. The landlord has lodged their own action against me for damages, minus the deposit I have claimed back from them. I still haven't received my decree - the court said it was posted yesterday and was held for 14 days as per their procedure.

    The landlord has filed the claim saying that they did forgot about the court date of 16th October.

    Is their claim still competent even though I've won the case? They have used their counterclaim exactly as was and have filed it again under their own legal action...
