    Hi all,

    I wonder if anyone can advise me on my problem.

    On 21 Aug at approx 10:50AM, I received a visit from a bailiff from Rundle & co who said he was acting on behalf of sutton council. He showed me his ID and wanted to know if a Miss G(full name is being omitted on here for obvious reasons.) lived at my address. I told him that she did not. He wanted to know if she had ever lived here to which I said that according to my landlord she did live here before I did. He then wanted to know when I had moved in and I told him on 22 Nov 2010. He asked me for my full name and I gave it to him. (Not sure why he wanted my name as he was looking for a female whilst I am a male.) He then thanked me for my time and left.

    Previously, I had received three letters from the sutton council, all of them being addressed to the named lady. I returned the first two unopened, using the return to sender method. The last one was returned, unopened, to the council offices in person, on 13 Feb 2013 together with a letter and a copy of my council tax bill. In the letter I told the council that the person they were writing to did not live at my address and that I did not know her or of her whereabouts. I asked them to stop sending letters to my address for this lady. I never heard from them since then. Instead, I received two letters from Rundles in June this year(2015), both letters were addressed to this same lady. I had intended to reply to Rundles to inform them of the situation, but unfortunately I got bogged down with other important personal matters and inadvertantly forgot about the bailiff matter.

    I am now considering filing a formal complaint with the council because I don't believe that the council had the right to send baillifs to my door regarding a matter which does not concern me and especially because the council knows that person being sought does not reside at my address.

    However, I am not sure who is to blame here: The council or the Baillif company. Hence the need to seek advice. Can anyone help?

    The Council, they instructed the bailiff, and the bailiff can only act on instructions given to them.

        Hi all,

        Just an update. I have received an acknowledgement letter from the council regarding my complaint. They have handed it over to the benefits and revenues team for investigation. Should receive a reply within the next 20 working days.

        Also, I have queried the bailiff company to get confirmation that they were in fact acting on instructions from the council. I also asked them to confirm whether or not the council had informed them that the debtor does not live at my address. I should receive feedback from them with two working days.

        Do you think I am doing the write thing?

          definitely :nod: ... this is all the council's b@ll$-up and they need to be given the chance to sort it out.
          Debt is like any other trap, easy enough to get into, but hard enough to get out of.

            If the Rundles drone calls again do not let him in as he might try to Take control of your goods, they really are that facey at Brundlefly & Co.

              Thank you for your reply.

              Do you think the bailiff will return? Why would he do that? From the letters they sent in June,it appears that the matter relates to a council tax debt owed by a previous tenant who is a female. The council obtained a liability order on 7 Sep 2010 against her. Surely, I am not liable for it. I am on council tax reduction and so don't pay such tax. I only moved into the flat in November 2010 and prior to moving in, the flat was vacant. Surely the landlord should be held responsible for any council tax due during the period in which the flat was vacant. Now that you've mentioned it, I did give the bailiff my name. Do you think that Rundles will try to hold me responsible for someone elses debt? Can they do that,legally?

                They might return if the council don't call them off, . No they cannot legally do anything to you, if they did return call the police and tell the police the bailiff has no right to be there as he is trying to get you to pay a debt for a former tenant, but Rundles are thicko's or act thick and they might try it on if the council doesn't pull the former tenants account, you do not have to let them in anyway and you could threaten them with the ICO for discussing a third party debt with you.

                    They have absolutely no right of entry end of, not your debt proof provided etc etc.

                        So I've just being doing some research on Rundles and according to the FCA's interim permission consumer credit register, Rundles's interim permission has lapsed on 30 June 2015 and is therefore inactive.

                        Could anyone explain what this might mean?

                        Does it mean that Rundles are no longer to allowed to collect debts on behalf of their clients from 1 July?

                        Are they legaly allowed to still send their bailiffs to take enforcement action?

                          They did not answer my specific questions, but instead wrote the following:

                          "Dear.... Thank you for your assistance in our enquiries, we can now confirm that we will direct all enquiries elsewhere and you will receive no further communication or Enforcement Agent visits from ourselves or our Representatives regarding this account. Yours sincerely Administration Assistant."

                          Any thoughts?

                            if email archive and print, they are saying you are no longer in the frame, but might forget to tell the bailiff on the case so if he fetches up shove the letter under his nose, tell him to read it then foxtrot oscar or the police are being called.

                            Thankfully this should be the end of it for you.
