  • PIP Tribunal

    Had my PIP tribunal on Friday and although I expect to lose I want to know what my options are if any
    The Chair made a couple of statements that i am worried about
    Firstly they asked me questions about my submission but also said they didn't want me to go over anything that was in my submission unless asked and but I was free to add extra info, I feel that they did not go over some areas but of course they may have made their mind up on that

    She said that the time frame they were looking at was my claim form date - 3 months and + 6 months

    The other thing she said was that time to do a task was irrelevant which I can't believe is correct

    Can I ask why you expect to lose? If you are fighting at tribunal stage in a PIP tribunal there must be mitigating circumstances somewhere that point in your favour :confused2:

      Well the chair said that I had made some interpretations that she didn't agree with but also there were some differences between what I put in my claim form and what I do now, examples being how I was addressing my budget . I am quite confident in getting an increase in points from the current 3 but I can't see, from the questions they asked how I will get to 8

        OK ... so you believe you should be in a higher banding than you were awarded? And you can/can't do things that were pointed out in the original app.?

        Have you been given a copy of your original review findings? Can you tell me what the differences amount to?

          The nurse who did the assesment was pathetic, listed my mediation down incorrectly, refused to take a copy of my notes I had to help me on the day and said there was a half empty bottle of cidre on the floor-I dont drink cidre, I am usually a scotch or vodka person.
          I got 1 point for using a dosette box and 2 points for continence needs due to the IBS .
          I believe that according to the descriptors I should get points for cooking and taking nutrition as well as points for managing money . Not sure if thats what you wanted to know

            That's definitely a good start BB ... anything like the pointers you have mentioned above will be useful in a PIP appeal :nod:

            From experience, I know they do not take into account half the things they should and they also tend to make things up as and when they like Most of the 'examiners seem to be underqualified too!

            Have you put in a complaint about them disregarding those issues (cooking/nutrition etc...) and for lying about the alcohol?

              It was all in my appeal documentation. Stupidly I applied for the mandatory Recon before I had the medical report . As I say I am just fearing the worst . They said the letter would be posted out either friday or monday so its a case of waiting . I am not currently at home and can not afford to keep popping back just to check the post, not at £7 a time-thats assuming I cycle to the train station

                  Just thought I should post an update

                  I finally got my statement of reasons and there were huge gaping holes in them, i.e evidence that I had presented that appears to not have been considered
                  I have therefore asked for a set aside, only problem, set asides should be asked for within one month of the tribunal -but how can you ask for a set aside when you don't realise you have reasons. In my letter I have been all nice and said there must have been a mistake and it is obvious the panel did not have the documents (I then listed the page numbers) they were oddly a chunk so all together.

                  I have also asked that should the set aside not be possible then could I please apply to the Upper tier on those grounds and also some errors in law, I named what I consider to be a few and evidenced the documents that led me to that conclusion . All I can do is wait

                  I have also asked for a record of proceedings as a very clever lady suggested that there should be a record, I should have asked for these right at the start

                  All I can do now is wait
