    Below are the next steps with links, basically a CCA request to Arrow and a CPR request to Restons, both by recorded delivery.

    2: Send A CCA REQUEST to the CLAIMANT ( see here )
    This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts.


    3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )
    The particulars are very sparse. :mmph: The only documents that can be requested on your CPR letter would be a copy of the contract and the notice of assignment as there's no mention of a default notice.

    What was this account originally? Some kind of Paypal credit card?

      yes it was a credit card, then later i believe was either bought out by Santander or they became a partner.

            Yes, you have 33 days from the date printed on the claim to submit a defence. If they don't send you anything you can just file a generic defence based around non-compliance with your requests for documents.

            If a default is mentioned then you can also request a copy of the DN in your CPR request letter. :thumb:

            For the CCA request Arrow have 14 working days to respond, if they don't the account becomes unenforceable as long as they are in default and you can use this fact in your defence, so you wouldn't want to chase them up.

            The CPR request should be replied to in 7 days, if they don't you should chase Restons. Keep an eye on the calendar and keep us posted. typing:

                      The CCA request is just for a copy of you agreement and nothing else as per the template letter.

                      • The original agreement or contract
                      • The notice of assignment
                      • The default notice

                          It's the Particulars of Claim (POC) i.e. what the claim is all about. You are requesting the documents mentioned in the POC so the
                          " contract" and the notice of assignment. Nothing else can be requested.

                            A statement of case is what used to be known as a 'pleading, i.e. a document used by a party to set out their case. Particulars of claim, defences, etc. are all statements of case.

                            The statement of case referred to in the CPR request letter is the particulars of the claim. I highlighted those items from the particulars you posted up, see post #8. :thumb:

                              Hi Flamming Parrot,
                              Today i received letters from Restons stating i hadnt signed the letter requesting documents CPR31.14 ive noticed they seem to do this alot. There reason is that they need to be sure they are corresponding with the correct person. Im aware of certain delaying tactics they implore.
                              So tomorrow i'll be resending the request with a tamper strip signed and see what happens next.
                              Arrow Global also returned my postal order with a letter stating....
                              Thankyou for your letter dated xx/xx/xxxx recieved on xx/xxxx we acknowledge your request for documentation pursuant to the consumer credit act 1974
                              We will now process your request for documentation from the originating creditor and will revert in due course.
                              All collection activity will be suspended pending provision of the documentation...

                              Should i contact the courts and let them know where were at so far and im awaiting documentation to form my defense?

                              Are the afformentioned letters a pretty standard response to my CCA and CPR requests?
