  • Removal within 48 hours Jacobs

    Received a letter from Jacobs stating removal within 48 hours. had a bailiff letter from them approx. 8 months ago, explained it was from an address I lived at over 6 years ago with an ex partner and as she had my bankcard I was under the assumption she paid it.
    My situation has changed dramatically since me and her broke up. I've had 2 minor strokes and suffer panic attacks and live with my disabled partner, so money is extremely tight.
    they asked for proof of benefit and the address of my ex, I explained I have no clue where she is. and they explained they were doing to start taking money from my benefit. at £5.00 and some change a week. 2 months after my benefit was stopped for some clerical reason and finally sorted 2 weeks later, I let them know they said nothing they could do as an agreement had been broken even though I explained.
    I told them all I could pay was £5.00 a week, they sent an email that the Council in question wouldn't accept that as it wasn't enough to pay off the debt, and the minimum I should expect to pay is £8.00 a week. probably sounds bad to others I cannot afford this, I lost my father a month ago and am seriously struggling with life itself and yet My ex works apparently and they wont chase her for it.

    What is the debt for? You mentioned Council ... can I assume it's a council tax debt?
    Debt is like any other trap, easy enough to get into, but hard enough to get out of.

    It doesn't matter where your journey begins, so long as you begin it...

      Good morning welcome to LB,

      What was the original debt, council tax?

      Are you and your now partner considered to be vulnerable persons because of your health problems?
      Has the bailiff been informed about health problems?
      Are you both dependent on benefits?
      As to the goods in the property who owns what? Are there and items of sufficient value that could be sold to satisfy the debt, do you have a car?
      If do have a car make sure it is either locked in a garage or parked somewhere well away from the house.

        It is a council tax debt, Jacobs are fully aware that we are both on a joint claim and that money is extremely tight, there is nothing in this property of any value, everything is charity shop or second hand from friends, and no car.
        I have tried to explain that all we could afford is £5.00 a week but they say that isn't enough, don't know where to go from here. and obviously my partner is in panic and im struggling to come to terms with the death of my father a month ago. wits end...

          OK ... for a council tax debt, the bailiffs do not have much they can actually do. The regulations changed April last year, and they are not able to enter a property by force or by any means other than a normal point of entry (so no climbing through windows etc...)

          As it is a CT debt, the council should be willing to return a debt at any time if there are mitigating circumstances (such as yours imo), so I'd suggest you put in a formal complaint with the council involved requesting they take back the debt and allow you to arrange a payment schedule with them :nod: email is OK to do this, and it means you would have proof of sending it too

          You do not have to deal with the bailiffs, if you refuse them entry they cannot force their way in to remove goods (unless you have previously allowed them in regarding this debt) so you could just say they're not allowed in

          You'll get lots of advice from the other Beagles too
