  • Do I have a claim against Tesco? Please help

    I was in my local Tescos 2 days ago when another customer crashed into me and my trolley and broke 2 of my fingers. I reported the whole affair to the Tesco store and it was entered in their Accident Book. I went to hospital and it was confirmed that I had broken 2 fingers on my right hand (I am tight handed) Even though it was another customer, I have been told I may have a case against Tesco because they (unlike other supermarkets) do not have bumpers or protective guards on their trolleys. They have a "duty of Care" to make their trolleys as safe as possible. Could anyone give me their advice/ opinion as to my chances of making a claim against Tesco

    Hi and welcome

    I would say no, it was an accident.

    Two fractured fingers would be worth surprisingly little in any event in damages.

      A simple fracture to a single finger from which full recovery is made within twelve months...............payout averages between £1700 - £3400 depending on which finger, hand etc.
      If you never make a full recovery (due to tendon damage?) and suffer stiffenss your compensation could be upto £11000+
      Your claim would cover pain and suffering, financial losses if any including lost income, medical expenses. travel expenses, home help etc

      The shop keeper has a duty to keep you safe whilst on their premises.
      It might be worthwhile having a chat with a specialist accident claims solicitor to see what your options are
