    hello hope someone is able to help my daughters friend. Apparently her mother as lived in the flat for many years and was an alcoholic so her daughter has been looking after her for quiet some time but was not registered at the address until 6 months when her mother was diagnosed with cancer. The funeral was last week and two days ago the daughter has had to go to the doctor suffering from depression and anxiety. On top of this yesterday she was told by the council that she had about 20 days to vacate the flat. She was registered has the mothers carer. The councils reason for the eviction was that she had only been registered has her career for 6 months and it should have been 12 months. Even though she has been looking after her prior to this. Any help in this matter would be very much appreciated.

    Can you tell us which council please, so we can access their Tenant's Charter (if they have one) to see if the council are following their own guidelines.

      Shelter has some clear information about succession rights here http://england.shelter.org.uk/get_ad...ouncil_tenancy but it would seem that some depend on the tenancy agreement but a child only has rights to succeed if they have been living there for 12 months.

        they are usually quite strict on this, for a number of reasons.

        1. was she registered or living anyware else
        2. does she own any other property
        3. is the rent low on the flat
        crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even

            No she doesnt own any other property. Before this she lived in a one bed flat with her sister then moved into her mums when she was diagnosed with throat cancer so became her official career. Yes the rent is low. She spent all of her savings on the funeral. There as been a fall out with the sister so she cannot return there.
