    Hello everyone two payday loans companies are giving me a refund
    1. wonga £577
    2. Mr lender £100.00

    I am waiting for Minicredit (unsuccessful payday company their licence is withdrawn) to get my money back by using missold letter

    Safeloans dont bother with them because their making threats to me

    I have investigated your complaint and find the following;
    First and foremost and for the avoidance of doubt the firm does not agree with your comments and we totally refute your suggestions that the loan was mis-sold to you.
    We point out the fact that you only had one loan with us which was settled before the contractual payment day. Our loans were offered over 1 to 4 months; the loan in question was repaid over a term of less than 4 months, raising no undue concern as many customers choose to borrow over this length of period. At the time of your application you would have completed budget planner information confirming affordability of the loan. Our lending procedures have been comprehensively reviewed by the OFT and its payday lending review on the 01.08.2013 in relation to affordability assessments undertaken by Safeloans when assessing a client’s loan application by the Payday Lending Team, Corporate Services, Office of Fair Trading who concluded “In respect of the affordability assessments currently undertaken by Safe loans it is clear that sufficient checks are currently being undertaken.”
    You have stated in your complaint ‘’this type of loan is a short-term loan and not intended for long-term borrowing’’. The term of borrowing for the loan in question was 17 days which demonstrates that the product was used correctly as Safeloans was a small cash, short term credit provider.
    In summary we do not agree with your accusations and claims, for the avoidance of doubt let us be clear there will be no consideration to repay any interest fees or charges in relation to loans issued, and no consideration for any compensation payment. The Company will carefully consider its position in all correspondence received in relation to any further unjustified accusations and claims and may be escalated.

    In their summary they is a making threats to me can i report them to FCA?

    Hello Iaintw,

    There is no threat of anything here, the company has explained
    clearly the consequences of making unjustified claims against it.

    It seems clear to me that you applied for and received a loan
    and repaid it within the terms and conditions.
    Why should you be compensated in any way?
    Care is needed when making unsubstantiated claims against a company.

        No Iain I sorry but there is no threat in that letter, safeloans has made it's companies stance clear on your complaints.
        Clearly you had the loan paid it off properly in time, so what is it you expect from the company.

        The FCA does not ( in the same manner that the OFT did not) respond to individual complaints.

          Wonga have been required to make restitution to many people by the FCA, I have had two balances written off and some compensation (well all the money I had actually paid them .
          Minicredit as you say have gone and their book has been sold to kapama , now although they have acquired the rights and duties of the original creditor I doubt that it would include compensation.

          While using irresponsible lending is probably appropriate in a court defence I do not feel you should be making claims against companies UNLESS you have suffered because you missed payments and were charged extra . For me I would rather let sleeping dogs lie , I think they have all gone away now and although two of them had lots of rollovers so I did pay a considerable amount of interest I think we are probably not far from quits

            I too wouldn't read what Safeloans wrote as a threat.

            However I don't agree you shouldn't ask for compensation for a loan that was given and repaid.

            I have seen clients who have struggled with payday loans and become so desperate that they have haven't paid priority bills so they can clear a payday loan. If the loan was clearly unaffordable because of the borrower's poor credit record or low income in relation to essential expenses, then a responsible lender should never have made the loan and it is right to ask for compensation., see http://debtcamel.co.uk/more-payday-refunds/ for more details.

              I have managed to get 4 loans written off leaving 3 to deal with, there's a lot of changes in this sector happening.

                Is there a template letter or specific legislation which can be used in a complaint letter for getting miss-sold loans refunded or written off?

                  People's situations are too individual for a template letter to be much help. This article looks at the sorts of things you could put in a letter of complaint: http://debtcamel.co.uk/more-payday-refunds/. Basically there are two grounds to complain:
                  - the original loan was "unaffordable"
                  and/or
                  - the lender did not handle your situation properly if you got in touch when you were in difficulties.

                    Story here about someone getting a large refund from Quick Quid for a lot of payday loans that were repaid on time - they were still "unaffordable" - http://debtcamel.co.uk/quickquid-payday-ombudsman/. He had to go to the Ombudsman but it was a very quick and painless process

                      I've had a good two weeks - Wonga refund of £220, Sunny loan written off £870, Peachy loan written off £250 - all from over 2 years ago.

                      I've also got complaints still ongoing with the FOS re irresponsible lending. Could be out of payday debt by christmas at this rate!
