    I am not sure if I have written in the right place but am really panicking. I have also been sent a letter from Northampton County Court Business Centre. I will have to get all of my papers out of the loft to confirm the exact details. In April/May 2012 I took my mum shopping the Co-op in Ryde Isle of Wight. This was always a car park that you paid on leaving. I drove in and there was no one to issuing the tickets as previous. I parked in a disabled bay, clearly displaying mum's disabled badge and took my mum shopping. Mum is severely disable with arthritis. It took us just over an hour and a half but as I believed we had three hours I wasn't too fussed. Also if the man came back to the ticket box he never charged a lot of money for parking there. When we left there was no one to pay and thought "that was handy".
    Some weeks later I received one of their so called Penalty notices. I tried calling and couldn't get through so wrote explaining my dilemma. I never heard back but continued to get bombarded with charges and them increasing them. To be honest if they had acknowledged my letter of appeal and said I still had to pay I would have paid the original amount but the charges kept going up. I had not noticed the signage, but later in the year I went back and there were a few signs saying free carpark for an hour and a half but nothing about the disabled parking bays. I went on line and every where I went I was told to ignore it as they can't enforce it. I did this and now I have a charge of £237.00. I feel that it is discrimination that they expect a person who is disabled to get their shopping completed in 1hr 30 mins.
    I would like to defend my case and want to write about them being discriminatory, but I am unsure what to write or where to start. if there is another way to defend I would be grateful of any help please. Again if I have written in the wrong place could someone point me in the right direction please? I do not want to reply on line until I have had some advice. Thank you in advance for any suggestions.

    Have you acknowledged the claim yet? This can usually be done online via MCOL https://www.moneyclaim.gov.uk/web/mcol/welcome using your claim reference and password from the front of the claim form.

      First thing is to acknowledge the claim. Next is to contact that particular branch of the COOP if you can and say that they are charging a holder of a disabled badge for using their store. Ask them to get it cancelled. May not work but it's worth a try.

      Who was in charge of the car park and whose name is on the court form? CEL for the car park and DEAL on the court form. Did you have a letter transferring the charges from CEL to DEAL? Unfortunately you may have told them who was driving. If they had not know that then they could not chase the keeper.

        Otherwise file acknowledgement of service. Sadly not as described by @Kati as they don't use money claim online.

                I haven't acknowledged the claim yet as I want to put my defence on there also. I will contact the Co-op, its worth giving that a go. I will have to get the paperwork out to ensure I have all the facts. On the claim form it is from CEL. They never acknowledged my letters. After not receiving a reply I just ignored all the invoices. I am just so angry at how customers with disabilities are treated by them I want to do battle with them.

                    You just acknowledge saying you intend to defend.

                    You then get a further 14 days to put your defence in.

                      If it was issued via MCOL then you should have a claim number and a password, full instructions for acknowledging via MCOL are here: http://www.legalbeagles.info/forums/...313#post499313

                      Just tick the box that says you intend to defend the whole claim, you can submit your defence later on. For claims issued via the Northampton Bulk Centre, it's a maximum of 33 days from date on claim. :thumb:

                        Well if it's a MCOL claim form you'll find them on the left just above the signature.



                        Also referred to as the particulars of claim.

                        You can scan it up blanking out your details as in the pic.

                            Hello All,

                            Well I blanked out my details but didn't do a very good job. they are old details now and I no longer have that car. I hope that they upload properly. I just need to find the copies of the two letters I sent them. I wrote the first letter after receiving the first charge as it isn't clear why they fined me. I got the second charge and again queried it, they still didn't respond so I ignored them. I wondered also as the first lot of fines/charged were from CEL, then I had a letter saying that they had transferred the debt over to DEAL and then they court letter has been filed by CEL. can they do this? Should it not be DEAL?

                            I did contact the Co-op were I was parked, they apologised and said they have thier own issues with the company and no longer use them. They did offer to re-eimburse me if I paid it. To be honest I don't fancy taking that chance and I am so mad with this company not being above board and honest.

                            What do you guys think? I appreciate it iseveryones personal opinions and won't hold you to anything. lol

                              Please note that the Parking Contravention Enforcement Notice has taken over a week to get to me, as you claim to have sent it on 23/04/2012. I am replying to you within 8 days of the date that you sent the letter out.

                              I do not know or understand the reason I have received this invoice. I was parked in the car park in a disabled bay, clearly displaying a disabled badge and have not gone over the three hours that is allowed for disabled parking. The Enforcement Notice says “in accordance with the Parking Terms and Conditions clearly stated on the signage”. I did not see any signage stating that I could not park in a disabled parking bay for this time.

                              I would be grateful if you can confirm which contravention I have broken as soon as possible.

                              RE: PCN 7763051402 Car registration
