    This is significant can we see the part of the SAR data confirms the sale of the debt for 10p please?

        ok,
        it was £10.... sorry mis-read that.

        So this was an overdraft facility on a current account, and I'm trying to establish how to find out if it was statute barred? How would I find this information from all this paperwork. I've read through but don't know what to look for, any help please??

            For an overdraft, the clock starts to run when the bank recalls the overdraft by issuing a final demand. That would be a letter sent to you a few months after you stopped having money going into the current account. The letter would have been headed as such but the bank may not have kept a copy of the letter itself, however, there may be a file note somewhere referring to such a demand being issued, or to the termination of the account.

            Depending on the bank and the overdrawn amount, the bank may not have recalled the O/D for some time after payments into the account ceased.

                Good Morning,

                So, on friday I received a Notice of Proposed Allocation to the Small Claims Track from the NCCBC.

                TAKE NOTICE THAT

                1. This is now a defended claim.

                2. It appears that this case is suitable for allocation to the small claims track If you believe that this track is not appropriate track for the claim, you must complete box C1 on the small claims directions questionnaire (Form N180) and explain why

                You must by 3 September 2015 complete the Small Claims Directions Questionnaire and file it with the court office

                and serve copies on all other parties.

                There is enclosed questionnaire, do I fill this in, and how?

                  That's just routine, you need to fill it in and return it as instructed. No reason to object to small claims allocation, always a good idea to tick 'Yes' to mediation.

                  You need to provide details of your local court as that's where you'd have to go if you need to attend a hearing, as well as giving dates when you don't expect to be available. No need for experts or interpreters and, under D3, only one witness to give evidence (yourself). :thumb:

                        Have you received any of the documents requested? If not, the mediation service will agree that mediation cannot go ahead unless they'd supplied you with the documents.

                          Take it easy when is the mediation appointment?
                          Believe me it is not a terrifying process at all, you only speak to the mediator not the claimants representative.

                          Most importantly you must have at the very least all the documents mentioned in the Particulars of the claim to hand, if not the mediator will decline to continue and will return the claim to the court for allocation to a hearing.

                            I've had no documentation from Bryan Carter to support their claim.

                            The appointment is for the 23rd september between 12 and 5pm. So do I just tell the mediator that no paperwork has been received from BC to support claim? Are they likely to ask me anything else, just don't want to get caught out by them?!

                                Hi Folks,

                                Just had a letter from CCBC, a Notice of Transfer of Proceedings.

                                It says.....

                                The Small Claims Mediation Team has been unable to secure a mediation appointment at this time. Please now follow the instructions as set out below

                                The claim has been transferred to the County Court Hearing Centre listed below for allocation. On receipt, the file will be referr to a procudural judge who will allocate the claim to track and give case management directions. Details of the judge's directions will be sent to you in a notice of allocation.

                                If you would like any further information you can contact the local County Court Hearing Centre directly but please await the judge's directions

                                HELP PLEASE!!!!
