Hoping someone can give me some advice.
I took out a small unsecured loan over 3 years with Welcome Finance account number 2301385 on 10/10/06, I can't remember how much it was for but its circa £3500. Admittedly I only made a few monthly payments due to unforeseen circumstances. I was young, naive and ignored all threats about legal action for many years.
In turn I was issued with a CCJ on 02/03/09 for £4894.54 by Welcome Finance with help from Howard Cohen & Co. I also chose to ignore this. So some 6 years passed with 2 house moves in that time with not a sound about said CCJ, It fell off my credit report and I was kind of hoping I slipped under the radar and I wouldn't hear about this debt again. Hold my hands up, completely wrong attitude.
Anyway fast forward to 19/06/2015 whilst i was doing my monthly check with credit reference agencies I noticed I had a new CCJ.
I didn't receive any paperwork about it as it went to my old address. After a phone call to Northampton Court it turns out Cabot Financial issued a new CCJ for £8573.44 after purchasing the Welcome Finance account in 2013 (an exact date couldn't be given). This was with the help of Weightmans Solicitors.
I spoke to Cabot yesterday explaining I already had a CCJ for this debt and was told I had to speak to a company called Marlin, apparently they are part of Cabot but the account is managed by them. Same account number: 2301385 as first CCJ.
I asked for more information, they claim the account didn't default until 17/11/10 and I made my last payment to it on 11/12/07 which is incorrect although I have no proof of this.
Marlin also couldn't tell me who they purchased the debt from but it wasn't Welcome Finance. So according to Cabot it would seem I defaulted on an account 20 months after the original CCJ was issued and 35 months after my last payment.
Marlin also refused to discuss particulars of the account and any challenge had to be submitted to Weightmans.
The court have emailed me particulars of claims for both CCJ's if they are help to anyone
Clearly some serious errors when it comes to dates.
My question as I keep reading conflicting information:
I'm aware a CCJ only stays on your credit file for 6 years but am I right in saying it is still infact enforceable until the debt is paid?
This meaning I now have 2 CCJ's for the same debt as the have the some account number?
As the debt has not been paid the original CCJ is still outstanding?
Enforcement on the original CCJ wouldn't result in a brand new one with different case numbers?
Should I claim for the new CCJ to be set aside?
Not holding my breath on Weightmans being to helpful.
Any advice whatsoever would be amazing.
