  • Application to vary or stay an order

    Hi

    Am helping someone with a claim and i need to put in an application to vary an order that has been posted Is there a template or advisory that i can read/copy.

    Or do i just send it to the court involved

    Its mid action, and the applicant has not/ will not/ state there case properly, what the wording i need if i feel they have no evidence of there claim ?

    any suggestions

        Hi. Just need to know how to wordsomthing. I will switch back to a lappy to post up our responce. We want them to state there case and produce evidence...

        our responce ( want advise on wording,

        Application to varyan order Date 3rd june 2015

        Claim Number A=======

        Claimant _============== Defendant : ===========

        Date 8thJune 2015

        We request avariation to the order included.

        We would be fullywilling to engage with the claimant, as we have extensivelybefore, if the claimant will formally state her case, withevidence that would allow us to check

        All the evidenceserved is in relation to prior us re-painting the gates, andre-delivering them. Not in relation to the claim

        We require fromthe claimant

        1. Any evidence or photos that they have of the gates, from AFTERthe gates were re-painted by us.

        All the evidence served is of the gates prior us re-painting them,not after,

        2. Details of exactly what she is claiming for, in items and totalcosts

        3 Any independent evidence ??
