    Issue Date: 15-5-2015
    Amount approx: 558.54
    Claimant: Lowell
    Solicitor: Bryan Carter
    Original Credit: Lloyds

    Particulars of Claim:
    The claimants clim is for the sum of 442.69, being monies due from the defendant to the claimant under an agreement regulated by the consumer credit act 1974 between the defendant and lloyds under Account ref ******* and assigned to the claimant on 30/06/2014 notice of which has been given to the defendant.
    The defendant failed to maintain contractual repayment under the terms of the agreement and a default notice has been served which has not been complied with.
    And the claimant claims 442.69
    The claimant also claims statutory interest pursuant to s.69 of the county act 1984 at a rate of 8%per annum from the date of assignment of the agreement to date but limited to a maximum of one year and a maximum of 1000 amounting to 30.85

    Have sent: Acknowledged the Claim

    Other Info: I have acknowledged the claim online today and intend to defend as SB, my question is do I now have until the 12/06/15 to gather my defence or am I still working to the 14 days + 5 days from Issue date of 15/06/2015 giving me until03/06/15?
    Just what you want to come back to after our first holiday in 8years!!

    What to do next? Any advice greatly appreciated. I have never had any dealings with Bryan Cater or Lowells and from reading other posts about them I am quite glad but a little worried about how to proceed and the the time scales.

      OK ... you've acknowledged the claim online and stated your intent to defend the claim. That gives you 33 days from the date of issue (on the claim form) before your defence is due in taking you to Friday 15th May according to the calculator link at the top of the page

          I'd suggest they are .... you have proof of postage and delivery then :nod:
          Don't forget you'll need to include a postal order/cheque for £1 with the CCA request (marked "for statutory fee only")

            Hi, again. I am aware I am running out of time to file my defence but I am going around in circles with all the reading I am doing and finding bank statements from years ago.
            The sum for which the claim is an old overdraft which has been inflated with charges on top of charges. I have read that the CCA does not apply to overdrafts so I have not requested one. Have I made a mistake? I still intend to file my defence as statute-barred as during April/May of 2009 I was unemployed and my husband was declared bankrupt.
            Do I send a SB letter to Lowell or submit it on MCOL?
