  • Premier Park offer to settle to avoid court proceedings

    Recently got a ticket near my place of work as my company have a deal with Premier Park that you put on a ticket for £2.50 and put a permit in the window and you can stay all day. My permit fell off one particular day and therefore technically went over my time as the ticket just displays normal times for the amount I put on (two hours I think). My company aren't very supportive and have no contract in place with Premier Park for me to reference and when I appealed to POPLA I wasn't very informed and clearly put the wrong things down.
    I have now had a letter offering to avoid court proceedings by paying the PCN of £100. I know I should have just appealed using the reason of the charge not being representative of their costs but wondered if this will still stand up in court as I didn't use it in the first appeal? Any advice would be much appreciated.

    Why would you want to avoid court?
    It seems to me that Premier Park's £100 claim is not a genuine pre-estimate of loss.
    Also, what rights do they have as to the ownership of the land upon which you parked?
    Fianally, the Beavis v Parking Eye case is due to be adjudged within the next week or two.
    Definitely don't pay these charlatans.

      It is not a FINE - just a speculative invoice - Do not pay - Ask for a POPLA code from then, do it in writing and keep copies of everything.

          They are not particularly litigious. Keep everything together in a safe place and come back if you get a letter before claim or actual claim.

          Pity about wasting the popla code but as it's a penalty you should win if it goes to court. Keep an eye out for the Beavis result.
