PCN from Excel Parking Services

Driver received a PCN at a car park in Derby on 26/03.2015.
The reason given is that the car was parked after the expiry time of the ticket.
The ticket was for 2 hours with an expiry time of 11:49am.
On the ticket is a "Period of Parking" stated which shows 11:38 to 11:52.
What does this mean?
In my opinion it is the time that the vehicle was overstaying in the car park, and is quite clearly incorrect.
Driver also believes that they returned to the car at 11:50 (by their watch) and removed the car from the car park as soon as possible.
I also feel that issuing a PCN for less than 3 minutes over is grossly unfair and does not take into account a reasonable and natural discrepancy between someone's watch and the time shown on the ticket machine, and that a charge of £100 does not reflect the value of any loss incurred on their part, especially as the maximum charge in the car park is only £3 for all-day parking.

What is your advice - should we pay up within the 'discount' , should we appeal immediately (do we have to provide a name and address?), or should we wait for them to get in touch.

So not Council then, you have what is termed an unenforceable invoice - click the little black triangle and ask to be moved to the Private Parking Forum where you will get plenty of help.

I am considering sending this letter by way of appeal -

Re. Parking Charge Notice No. XLxxxxxxx.

Dear Sirs,
With reference to the above Parking Charge Notice (PCN) I am requesting that you cancel the notice for the following reasons.

1. The driver believes they returned to the vehicle at the expiry time as shown by the drivers watch, and removed the vehicle from the car park within a very short period of time after that.
2. The PCN implies that the vehicle was parked outside of the expired time from 11:38 to 11:52. (“Parking Period”)
   This is clearly not the case if the expiry time is 11:49.
3. The fee you are requesting is unfair considering the short period between expiry time and removal of the vehicle.
4. The fee you are requesting does not reflect any potential loss of revenue considering the short period between expiry time and removal of the vehicle, and the fact that the maximum charge in the car park is £3 per day.

ive just looked on the BPA web site and Excel are not listed in the approved operators. Does that mean they can't trace the registered keeper?

If it is not a hire or lease car then wait for the notice to keeper to arrive (if this was a windscreen ticket). They may mess it up and make it unenforceable. After that write your appeal and also include that the charge is not a Genuine Pre Estimate of Loss and is a penalty, which is not allowed.

Put your appeal up first for comment before you send.

If you can, edit your original post to remove comments about "My wife" refer to the driver etc.

Excel may have moved to the Other Lot and therefore still able to gain keeper's details.

Yes it was a windscreen ticket.
the original post was not intended to show the appeal (see later post for that) merely state the facts, so don't see the point editing.
do you have any thoughts on what "Parking Period" means?
i think it's very ambiguous.

Probably should read observation period.

Wait for the notice to keeper. (should arrive within 28 and 56 days of the original date)

thinking of submitting this to the Private Parking Ticket Appeals service on parkingcowboys.co.uk - any thoughts - wait for NTK before doing so?
I really don't want to spend the time dealing with this (although I am neither driver or registered keeper) as I'm self employed, and lose money if I'm not at work, so they seem a reasonable option.

It's your money. Most of the people there are, or have been, great contributors to the various fora. Parking Cowboys are a friend of this site too, i believe.

There was a previous appeal service that many people recommended and that turned to crap with many people in a substantially worse of position and having to reclaim their money from paypal.

I don't expect issues from the service you mention but we can go through it for free and i never recommend any paid for service.
