CCO from Rossendales threats to put charge on house ..

  • CCO from Rossendales threats to put charge on house ..

    Hi

    I had a court case which ended aug 2010 the judge never mentioned payment for defence but i went to prison....

    In august 2012 rossendales wrote to my wife demanding £8000 she wrote back saying i was not about and we heard nothing until a couple of weeks ago when more letters and calls started from rossendales ..

    I have spoken today with them, they are arrogant pigs, i asked about a payment plan which they said max 6 months i don't earn £1300 a month..

    If i don't pay this week they will take action against me which will include a charge on my house which he said will stop me ever selling or taking loans against it..

    I don't know what to do next anyone help please ?

    Presumably this was a criminal case. Can you explain what you mean by payment for defence? Did you hire a solicitor to represent you and didn't pay him?

    What was the £8,000 debt for?

    A charge on your house wouldn't stop you from selling it, the charge would be paid from the proceeds of the sale if there's enough equity after paying the first mortgage. That means less money for you but the house can still be sold. As for remortgaging or taking out loans secured on it, it all depends on a number of factors such as the value of the property and amount of equity vs the value of the loan, your credit record and the individual lender's criteria.

    Could you give us a bit more information about the history of this debt?

      Thanks for the reply..

      The whole dept is for legal aid cost due to trial which ended in aug 2010 since then i have spent 36 moths in prison and 13 months out again ..

        Rossendales do have the government contract to collect these legal aid debts but I am not familiar with the relevant legislation covering enforcement so cannot offer much assistance. On the letter from Rossendales does it refer to the actual legislation?

          So its a capital contribution order then. Charging orders are quite common for this type of debt, you can arrange an installment plan and pay it off at the same time the charge sits on your property as security. If you defaulted on payments they could go for a sale order so it is important to ensure the payments are affordable long term.
          You should have had notification before now and had your income and assets assessed. Someone else on here had a similar issue a couple months back.

              Thanks for the reply me and my wife own the house outright its value is about £145,000 i don't mind the charge going on till the loans paid but its the intrest he said it will be 6% now from what i can only afford thats going to take along time ...

                Hi,
                Can anyone help please. I had a court case which ended in June, I pleaded guilty and was given a 2yr suspended sentence and 200hrs community service. I received a letter recently from Rossendles saying I Owe £61k for capital contribution order (legal aid).

                I don't have any assets or savings and was granted full legal aid And had to pay noting. Rossendales are threatening to put an order on my wife's property that she owns a 100% with no mortgage.

                When I first applied for legal aid my wife and I signed the legal aid documents to show our income. Now I am worried because they are threatening to put an order on my wife's property if I don't pay the £61k.

                Can anyone please help.

                  Hi Emirod3110,

                  Did the trial judge order you to pay or not to pay any contribution towards Legal Aid? Rossendales Collect are known for getting it wrong. Contact the Legal Aid Agency if they persist.

                        Glad to see you have contacted the LAA.

                        There is a backlog in a number of government departments, including H.M. Courts & Tribunals Service (HMCTS). The length of wait is 2-6 weeks, depending on the department involved and size of backlog within that department.

                          I don't want to alarm you and i expect all cases are different , I ended up paying the money after they used an external solicitor who took the case to court in my absence, i one day got a letter from this solicitor saying my dept had been cleared by a judge to put a charge on my property, i could attend the hearing and defend why i don't owe the money or pay up and the case will be ended, if i went to court and fight the dept the costs will be aded to my dept (they had already added the cost of the court and solicitor fees to get the judge to agree the charge). I ended up borrowing the money from my parents just to get the twats off my case...

                          After extra cost etc i ended up owing £8750 if it wasn't for the 6% interest on the charge on my property i would have let them do it then i wouldn't have ever moved ....

                          61k sounds extreme as its done on value of assets, you mention wives house is your name not and never been on the deeds? does your wife own outright or mortgage ? these all should reduce the payment...

                            She owns it outright, No mortgage the money for the property was a gift from a late grandmother. And my name has never been on the deeds.

                              I think you need to get advice from a solicitor, my £8.5k hurt paying that much after i was granted full legal aid, the judge never asked for costs and loosing three years money while in prison and my wife struggling on benefits but yours is substantially more..

                              I used to feel sick coming home from work every night looking for the envelope from Rosendales, i tried talking to them but got nowhere, they said i could pay in 6 instalments..

                              The citizens advice were useless and advised me to get a solicitor that specialises in this but to pay i would need legal aid vicious circle ..
