  • Contesting Non Molestation Order - advice needed

    I am not sure how to make a new forum post so I have added it to this thread.

    My close friend has received a non molestation order delivered by an aggressive bailiff that forbids him from seeing his ex girlfriend or contacting her. They have had a very volatile relationship. He is a gentle man and is opposed to male violence. She on the other hand has regularly attacked him and one occasion when he went to the doctors for an unrelated illness, they questioned and took notes about his injuries. He also had some phsychaitric help and in a doctors letter several years ago it mentions that he has been abused by his partner.

    He never wants to see her again, but in the non molestation she lists false acts of violence and rape and he believes she will be circulating this amongst their shared group of friends.

    My brother is desperate to clear his name and would be quite happy if it were agreed that they both would never see each other again. The non molestation order states that he can provide information to the court before hand but doesn't say what that is.

    My brother is hard up and cannot really afford a solicitor to go to court although if necessary the family will try and support him. I would like to know:
    a. Can I a non legal person or other friends attend court and speak on his behalf or is it just limited to him and a solicitor?
    b. is it possible to argue there should be a two way non molestation order in place so she cant attack him. He lives in a small town and is very worried if he meets her in a pub and she is drunk. ( he also had an affair, which she is very bitter about and wants to destroy him and has said that).
    c. What chances has he got of overturning this non molestation order completely . On the one hand she doesn't have any evidence at all, however she has made some pretty nasty claims and a judge has obviously agreed the non molestation ex partia, so they look like they believed her. They don't have kids so there is no reason for any contact, but it is his reputation that is at stake here. Is he screwed or does he have a chance?

    Any suggestions would be very helpful as he is just looking at a place to start and is deperate. He has never been in trouble with any authorities and up until now has been considered a great person in the community.
