  • 28 day extension advice

    Hiya

I'm due to file a defence no later than the 17th of March. I sent a CPR 31.14 request to Drydens and they sent me a letter saying matter on hold so I wrote again asking them to agree to the 28 day extension. As I'd heard nothing from them I applied for an N244/unless order as I CCA'd them 3 weeks before the claim form dropped through the letter box and no reply to that either!. This morning I received a letter from Drydens in which I think they've agreed to the 28 day extension. They wrote,

Our file currently remains on hold pending our client's response and therefore, please accept this letter as confirmation of our agreement to a 28 day extension to the timescale during which you are required to file your response to the claim which has been issued against you.

I emailed this letter to the court and this was their reply,

Thank you for your e-mail and the confirmation from the claimant solicitors however once an Acknowledgement of Service has been provided you will need to file your defence by 17/03/2015. The e-mail from the claimant (actually it was a letter!) does not state they have extended the time for you to file your defence by 28 days.

So apparently no 28 day extension and a mighty confused me!

    Many thanks

It looks clear enough to me ... they're giving you a 28 day extension! You could try re-sending it and highlighting/quoting the bit that proves the extension??

Well that's what I thought too! I was relieved when the letter arrived but that was short lived!
