  • County Court Claim for a credit card debt from 2004

    Claimant: Cabot Financial through their solicitor Mortimer Clarke for sum of £900 + costs

    Hi, I received a county court claim which was issued on 09/02/2015. In which they have stated they the debt is from 2004.

    Not knowing what to do, I acknowledged service on 28/02/2015. I only found by reading some of the threads that I had to request information from the claimant, which I did not.

    Please guide me how to file a defense, as tomorrow is the deadline.

    There are some example defences on the site but they refer to the claimant not supplying documents, which wouldn't be applicable in your case if you didn't request them in the first place.

    Do you know what this debt is for?
    If you do, can you remember how you opened the account?
    Did you ever send a CCA request for this account?
    Have you got any grounds for disputing the account?

      Yes this debt was for a capital one card.
      I don't remember how opened the account as it was back in 2004 according to them.
      After reading some of the threads, I guess this debt is statute barred but still they have sent a county court claim.

      Please advise how to submit a defense?
