Re: 'PCN' from London Parking Solutions

    Hi mystery1

I have the original parking permit issued by the managing agent before LPS were ever involved. I'm thinking of sending that to them as well.

Re: 'PCN' from London Parking Solutions

I wouldn't because you're arguing that you don't require one as you have the right to park there as per your lease and payment and that doesn't require you to use a permit.

Re: 'PCN' from London Parking Solutions

        Hi mystery1

Yes, I'd reached that conclusion (eventually) too. I'm just sending the original ticket as proof of trespass, the emails and letters as proof of harassment, and as proof of sending the appeal within the time they stipulated, the lease as proof of right to peaceful enjoyment and exclusive right to park, and covering letter per your advice.

I'm going to send it Royal Mail signed-for.

        Many thanks as ever,
        Minxi

          Hi @mystery1

Here is the Gladstone Solicitors response to my letter, which has arrived by email:

          Mr (Minxi)

We write further to your 'letter before action' dated 11 November 2015.

You are unclear as to whether you intend to issue legal proceedings against Gladstones Solicitors or London Parking Solutions.

If it is the case that your allegations are directed towards Gladstones Solicitors then they are rejected. In response to your specific allegations; we have sent one letter to you in total which we think the Court will agree does not amount of harassment, and as a firm we have never visited the relevant land.

If your allegations are directed towards London Parking Solutions then we have no instructions to respond and we would suggest you provide clarification.

Please be aware that if a claim is issued it will be defended and costs will be sought on an indemnity basis.

          Kind Regards
          Rebecca Grainger

Re: 'PCN' from London Parking Solutions

            Dear Ms Grainger,

Thank you for your letter of xxxxx the contents of which are noted. I would advise that the letter before action is for your client and as you wrote on their behalf it was reasonable to assume you were acting upon instruction from them. I am sorry if this is not the case but i was not aware that you were not instructed.

As you are not instructed, please keep all paperwork, calls emails etc available in case a trial is required. As you are not instructed in a legal capacity nothing will attract legal privilege.

I will, of course write to LPS directly.

            Yours etc

Then resend the letter before claim to LPS.

            Letter Before Action

            Dear London Parking Services,

Thank you for your recent letter of xxxxxx reference xxxxxx sent by your agent Galdstones solicitors the contents of which are noted. Yourself and your various agents have previously been warned that their actions amount to harassment. (exhibits 100,101,102, etc)

I have pointed out that :-

            1. I have appealed which has not been answered (exhibit 1)

            2. I have paid for the right to occupy the land in question and there is no contractual requirement to display a permit. (exhibit 2)

If, within 14 days of service of this letter, i do not have confirmation that this matter is closed i will lodge court papers without further warning for harassment and trespass upon my paid for space.

I include copies of all threats made by you and your their agents (exhibits 3,4,5,6 etc)

            Yours sincerely

            M1
