  • Agency work regulations issue?

    Hi, When I was working by Recruitment Agency (from 08.2012 to 04.2014) I did not get pay rise after 12 weeks and from
    April 2014 I am working Full Time in the same place doing the same work. In November 2014 I have found out that I can get
    money back from Agency for that time I should get pay rise (some other workers have already get money back) however Agency
    do not want to pay me. After my calculation based on P60 and payslips Agency should pay me about 2900 pound. Is there
    anything I can do to get my money from them? Is it not too late to do anything?

    I have been in local citizen advice and They have send an email to Agency but from about 3 months Agency only replay that
    They are loking in to it.

    Were you working as a 'temp' through an agency?
    Was there anything in their terms and conditions saying you'd get a pay rise after 12 weeks of work or where did you get this idea from?

      I am not sure what was in terms and conditions (I have never recived copy of my contract) however other employees have the same contract and all already get refund and I know about it from them but Agency do not want to pay me.

      I have been adviced by ACAS that I need to go to the County Court (small claims) and open a case against Recruitment Agency (infringement of Agency Work Regulations) but Citizen Advice is saing that I may have small chances to win so I just do not know what to do.

      Is it not too late to do anything?
      Do I have any Chance to win?
      Do I need solicitor in Court? Where Can I get free solicitor from?
      Is there anything else I can try to do?
