    Is it possible to Establish paternity in court without taking a DNA test.

    A judge has given direction for me to take a DNA test for my 5 year old and 3year old Daughters.
    I have already had a private test for the 5 year old and she is definitely mine.
    I have not had a test for 3 year old.
    The thing is I have always believed she was mine but what if she's not this would be devastating to me and all my children.
    If i take the test and the test is negative she would lose her identity.
    There is nobody else to to take on the roll as father.

    Under the convention of human rights a child has the right to have an identity.
    can i use this as a reason to refuse the test and try to prove in court without the test that iam the child's father.

      Why has the judge ordered that you have to do DNA tests? (Is your ex denying that you are the father?)
      Have you told the courts that you have already had tests on the older girl (and shown them the results)?

      Why do you believe that your daughter will 'lose her identity' if the tests came back that you weren't the biological father? - She has been (and always will be IMO) your daughter for as long as she has 'known' you, that has to count for something!!

        I don't think a child loses their identity because the father is the milkman and not the dustman. There is "being a father" and BEING a father. I recently watched Jeremy Kyle(please don't hate me on this) and a father was convinced that a girl was his daughter even integrating her into the family. Yes she was devastated to find out that he was not her father but the man stood by her and that is the important thing. Furthermore, the child has a connection to you forever.....her sister which will never change so there are positives in this even if you might not get the response you want.

        I personally believe the DNA test going ahead would go against your argument that not knowing who she really is, ie not knowing for certain who her father is could be seen as denying her rights to know her family.
