      Hi responding to PM.
As much history as you can provide will help us to advise.
Have you checked your credit files for this account?
Look for the default date and the balance outstanding. Is it the same as the amount claimed?
I've beaten Cohen on these store cards in the past, particularly on Satan's Bank poor paperwork.

This is a credit card and there is nothing about this account showing on" noddle or Equifax ".

Ok, not on CRA files so defaulted more than 6 years ago, has it been established when the last payment or written acknowledgment of the alleged debt was made?

                Re: County Court claim

Found a statement of acc from Santander dated 25/05/2013- bal £2738 which is around the amount being claimed by Hoist .
There is no acc number on statement only the card number which is not the same as the one quoted on Court form .

Have you sent a CCA request to Hoist?

                    Re: County Court claim

CCA sent but they haven't replied within time period ,no reply from Howard Carter concerning CPR .
I sent recorded del and have signature to confirm delivery .
Strange how this acc is not registered with any CRA .
I only have a couple of days to get my defence in .

                    Thankyou .

                      Re: County Court claim

Without the CCA the debt is unenforceable until it is produced.
Might be an idea to check with the court to see what if anything is happening.

Ok, a stay may not show online, a quick phone call to the court is the most reliable way of finding out!

Just phoned and nothing showing ,was informed I have till tomorrow to file my defence .
Just got a letter of Robinson Way, in it they confirm that no action will be taken till the 27th March , don't trust them tbh ,do I need to get my defence in now rather than later ,the clocks ticking .

                            Thanks.
