  • Chances of success with a third party debt order?

    Hi,

    I filed a claim against a former housemate for her unpaid share of bill money. This was done via Money Claim online. She did not respond and I won judgement by default.

    I then filed an order to attend court for questioning. She produced bank statements to say she had little money in her account, was currently only doing temp work and also owed money to her local council.

    I understand that she has since found full time employment and I want to file a third party debt order to claim the money from her bank account.

    Will this be accepted, seeing as the last info the court had was that she was a) unemployed b) low on bank account funds? Should I file another order to attend court for questioning to get up to date info?
